Choose Civil Route, Irwansyah Can't Bear to Imprison His Own Brother

Kapanlagi.com - Previously, Irwansyah had reported his brother Hafiz Fatur to the South Jakarta Metro Police for a case of forged power of attorney that caused him and his wife Zaskia Sungkar to lose up to Rp 5 billion. However, after discussing with the police, Irwansyah decided to take this case to the civil route.

This was conveyed by Irwansyah's legal counsel, Muhammad Zakir Rasyidin, at the South Jakarta Metro Police, Friday (7/1). "Today we only sent a letter, brought a letter related to conveying that our client is focusing on the civil case," he said.

Irwansyah plans to file a lawsuit at the Tangerang District Court on January 10. "We plan to file the lawsuit on Monday (10/1). Yes, at the Tangerang District Court," he said.

1. Will Withdraw the Report

In addition, Irwansyah will also withdraw his criminal report in the near future. Because the Supreme Court prohibits the same case from being processed through criminal and civil channels.

"So regarding the criminal case, we will withdraw the report. Because it cannot be processed through the same legal process. Regarding the (criminal) report, we will postpone it and immediately proceed with the withdrawal," said Zakir.

2. Reluctant to Imprison His Brother

Irwansyah's reason for taking the civil route is in the hope that his assets can be recovered. In addition, Irwansyah also seems reluctant to imprison his brother.

"Because it is clear that his actions have caused losses. In criminal cases, we cannot claim for those losses, they can only be claimed in civil law. The losses I mentioned yesterday amount to around Rp 5 billion. There are 4 houses and 1 car, so that's what I will focus on," he explained.

"Actually, I feel reluctant, but because his actions caused personal losses, so... you know," Zakir continued.

3. Hafiz Fatur Still on the Wanted List

Until now, Hafiz Fatur is still on the wanted list.

"I still don't know where he (Hafiz) is. I have never met Hafiz and I don't really know him," he concluded.

4. Forgery of Signature

Hafiz Fatur, Irwansyah's brother, is suspected of forging signatures and documents. The report has been submitted to the South Jakarta Metropolitan Police since November 19, 2021. According to Irwansyah's legal counsel, the report is related to signature forgery.

"This report is related to allegations of signature forgery. Our client was shocked when a bank sent a bill to his house, stating that Irwan had not paid installments related to a loan from the bank. Irwan was surprised how I could be billed when I never took out a loan," said Irwansyah's legal counsel, Zakir Rasyidin, during a press conference in Senayan, Central Jakarta, on Monday (3/1).

5. Apply for a Loan to the Bank

Zakir explained that Irwansyah's younger brother, Zakir, forged signatures to borrow money from the bank worth IDR 1 to 2 billion. Not only Irwansyah's signature, but his younger brother also forged the signature of Zaskia Sungkar.

"After cross-checking, I found many letters. It is strongly suspected that Hafiz forged the signatures of Irwan and Zaskia Sungkar for his own interests. His interest was to borrow money from one of the private banks. Amounting to 1-2 billion," he said.
