Former Wife of Yama Carlos Appeals for Custody Rights, Accusing the Judge of Being Unjust

Kapanlagi.com - Arfita Dwi Putri, who is the former wife of Yama Carlos, spoke about the decision of the Tangerang District Court to grant custody rights to Yama Carlos. Arfita firmly stated that the judge was unjust in making that ruling.

"We consider the decision to be careless, unjust, and detrimental to our client," said Henry Indraguna, Arfita's lawyer, in the SCBD area, Jakarta, on Thursday (5/10/2023).

1. Not in accordance with the law

If in accordance with the provisions of the law, custody automatically falls into the hands of the mother when the child is still underage when the parents divorce. Meanwhile, in the case of Yama Carlos and Arfita, their only child named Marco Armanda Blessio Carlos is still 6 years old.

"However, the child is underage. Even according to the law, the child should fall into the hands of the mother," said Henry Indraguna.

2. False Accusations

In the court's decision, the judge of the Tangerang District Court handed over custody of the child to Yama Carlos based only on stories that according to Arfita are false and irrelevant.

"The considerations are funny. First, it is said that Arfita likes to get drunk. But Arfita only drank wine once while with her flight attendant friends. And Arfita did not come home drunk," said Henry Indraguna.

"Second, the issue of Arfita not preparing food for Yama Carlos. Is such a reason taken into consideration for custody of the child? If she just didn't cook, what else can she do? Arfita also works," continued Henry Indraguna.

3. File an Appeal

Therefore, Arfita officially filed an appeal against the decision of the Tangerang District Court which granted custody of the child to Yama Carlos. Arfita will strive for the child, who was born from her womb, to be raised together with the agreed-upon provisions.

"The child should be raised by both parties. There is no former father or mother," said Henry Indraguna.
