Komnas Perempuan States Gisella Anastasia as a Victim, Not a Suspect, Should Receive Legal Protection

Kapanlagi.com - Gisella Anastasia officially became a suspect in the case of the explicit video that was widely discussed in November 2020. On the other hand, the National Commission on Violence Against Women (Komnas Perempuan) considers that the decision of the police is inappropriate. 

Quoting from Kompas.com, Commissioner of Komnas Perempuan, Siti Aminah Tardi, said that Gisel should not be a suspect but rather a victim. 

"GA and MYD are victims of the dissemination of this content who should receive legal protection," said Siti Aminah Tardi as quoted from Kompas.com, Thursday (31/12/2020).

1. Not for Distribution

Quoting Article 4 Paragraph 1 of the Pornography Law Number 44 of 2008, Siti Aminah revealed that what Gisel did was not intended for the public or for distribution. 

"Both of them engaged in sexual activity and recorded it not for the purpose of the pornography industry or for distribution. So GA and MYD are victims of the dissemination of intimate content," she said. 

2. Should Receive Legal Protection

Siti Aminah also revealed that in this case, Gisel, as a victim, should also receive legal protection. According to her, this is a defamation case.

"The content should be investigated, where it came from, how and why it was spread. That's what is important to be subject to the law. Also, the healing of GA's image and family, this is what law enforcement should do," she explained.

"If spreading information about GA, what is the benefit? It becomes gossip. If you want to provide benefits to the public, the news should focus more on the unfair situation that GA is facing because she is the one whose reputation is being tarnished," she added.

3. Police's Testimony

Different from Komnas Perempuan, the Police have a basic foundation for why Gisel and MYD were declared as suspects. The Head of Public Relations of the Jakarta Metro Police, Police Commissioner Yusri Yunus, said that they became suspects because the video had become public consumption.

"For personal consumption, but the problem is that it has spread everywhere and become public consumption," said Yusri Yunus quoted from detik.com, Thursday (31/12/2020).

According to Yusri, Gisel's unlawful act was committed because she had spread the video to MYD.

"Her first act was to engage in pornography, she recorded a video, and then she sent the video to MYD," he continued.
