Kapanlagi.com - Mila Machmudah Djamhari, through her lawyer, Edi Prastio, filed a complaint with the Metro Jaya Regional Police on Thursday night (10/7/2021) regarding the marriage of Lesti and Rizky Billar.
The articles used to charge the couple are Article 266 of the Indonesian Criminal Code (KUHP) regarding document forgery and Articles 14 and 15 of Law No. 1 of 1946 concerning the dissemination of false news.
"Article 266 carries a sentence of 7 years. Meanwhile, Articles 14 and 15 of Law No. 1 of 1946 carry a sentence of 10 years," said Edi Prastio, a lawyer and chairman of the Indonesian Youth Congress (KPI) East Java at the Metro Jaya Regional Police on Thursday (10/7/2021).
To strengthen the complaint, Edi Prastio claimed to have submitted several pieces of evidence to the police.
"The evidence we submitted includes the programs uploaded by two TV stations, the fatwa from the Indonesian Ulema Council (MUI), and the views of Bathsnul Masail PWNU East Java," said Edi Prastio.
In his complaint, Edi Prastio stated that they do not question the validity of Lesti and Billar's secret marriage. However, they are concerned about the allegations of lies made by Lesti and Billar.
"If the secret marriage is not a problem, it is valid according to both religious and marriage laws. But what we question is the technical recording of the marriage at the Office of Religious Affairs (KUA). There is a suspected lie there," said Edi Prastio.
"The lie, why didn't they go through the isbat process? There is a mechanism. If they report it to the KUA, it means that the current marriage and the pregnancy, who will be the child's lineage? But if the secret marriage is then validated by the Religious Court and recorded at the KUA, it will be resolved," he added.
"Of course, our client hopes that this education will educate the public so that there is no commotion regarding this secret marriage," continued Edi Prastio.
According to Edi Prastio, his client will withdraw the complaint if Lesti and Billar are willing to admit their mistakes and apologize to the public.
"It would be better for them to gracefully make a statement to the public acknowledging the mistakes and the process. Or not seek opinions (about secret marriage) from MUI, Islamic organizations, NU, Muhammadiyah. Don't go to stage scholars," he said.
