Infidelity not only destroys households but also has significant legal implications. This is what happened to Paula Verhoeven after being declared to have cheated during the divorce process with Baim Wong at the South Jakarta Religious Court.
As a result of being proven to have an affair with another man, Paula lost her claim to a substantial amount of alimony that she demanded.
"With the respondent being declared as a disobedient wife, her rights as a wife to receive iddah maintenance and madya maintenance are automatically stated as not entitled," said Suryana when met at the South Jakarta Religious Court, Wednesday (16/4/2025).
In her lawsuit, Paula had demanded madya maintenance of IDR 800 million and iddah of IDR 600 million. However, all of that was dismissed because the panel of judges stated that she was disobedient due to proven infidelity with a man with the initials NS.
"Because in the provisions of the Compilation of Islamic Law Article 149 letter (b) it is very clear, a wife who is divorced for both madya maintenance or iddah is with the condition that she is not disobedient," explained Suryana.
Paula only received one right as a divorced wife, which is mut'ah amounting to Rp1 billion. This amount was decided after considering Baim Wong's financial capability and appropriateness.
"What is most decisive is that the value of mut'ah is considered based on ability and appropriateness. If it were 3 billion, it might be too much; 100 million is too little. Therefore, the council considered what is most suitable and reasonable," said Suryana.
This maintenance must be paid by Baim before the divorce declaration is made in the upcoming session. If not, the divorce process cannot continue.
Paula's infidelity became a double blow, damaging the household and causing her to lose the financial rights she initially fought for. Now, the judge's decision is just waiting to be finalized for execution.
