Summoned by the Police, Irwansyah Must Choose Whether to Prosecute His Brother Criminally or Civilly

Kapanlagi.com - Artist Irwansyah recently made a report addressed to Hafiz Fatur, his brother, to the South Jakarta Metro Police regarding the forgery of a power of attorney. Recently, Irwansyah also filed a civil lawsuit against his brother at the Tangerang State Court.

However, before doing so, Irwansyah sent Muhammad Zakir Rasyidin, his legal representative, to discuss it first with the investigators at the South Jakarta Metro Police.

"There is a Supreme Court regulation related to when there is a similar case, and the civil case is ongoing, then the criminal case is suspended," said Zakir, on Thursday (6/1).

1. Irwansyah Still Discussing

Therefore, Zakir will first discuss with his client, Irwansyah, which route to take, whether civil or criminal against his brother.

"Let the client decide. We leave everything to the client," Zakir concluded.

2. Irwansyah Called by the Police

South Jakarta Metro Police Criminal Investigation Unit Chief AKBP Ridwan Soplanit explained that investigators have sent a summons letter to Irwansyah. He said that the summons letter contains a call for the Love Story film star to provide information as the complainant in a case of document forgery committed by Hafiz.

As planned, the examination of Irwansyah will be conducted on Friday, January 7, 2022 at South Jakarta Metro Police. "Irwansyah is scheduled to be summoned this week. He will be called on Friday," said Ridwan when contacted on Wednesday (5/1/2022).

3. House Seized

As a reminder, Irwansyah and his wife, Zaskia Sungkar, were suddenly visited by the bank officials who wanted to seize one of their houses in the Bintaro area, South Tangerang. After investigation, it turns out that Hafiz Fatur had stolen the house certificate and used it as collateral with the bank by forging Irwansyah's signature.

Hafiz Fatur himself is currently a fugitive from the police as he is suspected to be involved in the Tipikor case of the Briguna facility at the BRI Bank Branch Office (KCP) Tegar Beriman.

4. Forgery of Signature

Hafiz Fatur, Irwansyah's younger brother, is suspected of committing forgery of signatures and documents.

The report has been submitted to the South Jakarta Metro Police since November 19, 2021. According to Irwansyah's attorney, the report is related to forgery of signatures.

"This report is related to allegations of forgery of signatures. Our client was shocked when a bank sent a billing letter to his house. Irwan was surprised how I could be billed when I never had a loan," said Irwansyah's attorney, Zakir Rasyidin, during a press conference in Senayan, Central Jakarta, on Monday (3/1/2022).

5. Apply for a Loan to the Bank

Zakir explained that the forgery of signatures was done by Irwansyah's brother to borrow money from the bank amounting to Rp 1 to 2 billion. Not only Irwansyah's signature, but his brother also forged the signature of Zaskia Sungkar.

"After cross-checking, I found many documents. From these documents, it is strongly suspected that Hafiz forged the signatures of Irwan and Zaskia Sungkar for his own interests. His interest is to borrow money from one of the private banks. Amounting to 1-2 billion," he said.

6. File a Report to the Police

Irwansyah's own report has been submitted to the South Jakarta Metropolitan Police since November 19, 2021, with report number /LP/B/2345/XI/2021/RJS/PMJ. The Legal Counsel mentioned that until now, Irwansyah has never met with the bank.

"Finally, last November, I, as the legal counsel, made a report to the South Jakarta Police. Regarding the forgery of documents, because indeed what we found was a credit agreement, then a letter of release of rights. Then there is a statement letter with Zaskia and Irwan's signatures. The fact is that Irwan has never met with the bank," he concluded.
