Wenny Ariani's Lawsuit Against Rezky Aditya Will Be Decided on February 3, 2022

Kapanlagi.com - The Tangerang District Court held another hearing of the lawsuit filed by Wenny Ariani against actor Rezky Aditya on Wednesday, January 19, 2022. In the hearing, both parties presented their conclusions regarding the examination process of the case.

After receiving the conclusions from the plaintiff and defendant, the Panel of Judges scheduled to make a decision on February 3, 2022.

"Earlier, the hearing concluded with statements from both the plaintiff and the defendant regarding the examination and the decision will be made on February 3," said Hakam, SH, MH, Wenny's legal counsel, who was met at the Tangerang District Court on Wednesday (19/1).

Facing the verdict hearing, Wenny Ariani is prepared if the Panel of Judges does not grant her lawsuit.

"If the outcome is not as expected, if our lawsuit is not granted, we will definitely take legal action and appeal," said Hakam.

"However, if it is granted, including the petitum and our request for a DNA test, I am sure the defendant will take legal action. So our client's fight is still long. What is clear is that our client is committed to fighting for the rights of the child, including knowing that the defendant is their biological father," Hakam continued.

As previously reported, Wenny Ariani, who claims to have a child with Rezky Aditya, filed a lawsuit at the Tangerang District Court on July 30, 2021.

In the lawsuit, Wenny accuses Rezky Aditya of committing unlawful acts and requests Rezky Aditya to undergo a DNA test and acknowledge Naira Kaemita Tarekat or Kekey as his biological child.

In addition, Wenny also requests the Court to seize Rezky's assets, namely a house and a four-wheeled vehicle. Wenny also demands material and immaterial damages totaling Rp. 17.5 billion.

In a previous hearing, Rezky Aditya, through his legal representative, submitted a document rejecting Wenny Ariani's request for a DNA test. The reason for Rezky Aditya's refusal to undergo a DNA test was read out by the Panel of Judges in the courtroom.

"The plaintiff has no valid reason or legal basis to request the defendant to undergo a DNA test. It has been proven in the trial and supported by witnesses that there was no marriage between the plaintiff and the defendant, so it is highly unlikely for the defendant to be forced to undergo a DNA test," said the Judge in the courtroom.

Furthermore, in response to Rezky Aditya's rejection, Wenny's legal representative, Hakam, SH.MH, tried to submit Wenny as evidence by swearing that she had a special relationship with Rezky Aditya.

"To resolve the issue related to the lawsuit we filed, the only solution is a DNA test. However, it was rejected, so we humbly request that you grant the suppletory or, if not, the decisory," said Hakam.

Unfortunately, the request by Hakam to make Wenny as evidence was rejected by the panel of judges.

"At the request of the plaintiff's representative, the panel of judges cannot proceed. A sworn statement can only be made if no evidence is presented. Because previously, you have submitted several pieces of evidence," said the Panel of Judges.
