Together with VISI, David Bayu Reveals the Reasons for Submitting a Judicial Review of the Copyright Law to the Constitutional Court

Musician David Bayu is one of the musicians who submitted a judicial review of the Copyright Law to the Constitutional Court (MK). This step was taken together with Vibrasi Suara Indonesia (VISI) as a form of concern over the royalty system that is considered unclear.

This decision is not just a trend, but arises from the anxiety of musicians regarding legal certainty in the distribution of copyright.

"Yes, actually our concern is like that, because as singers and as creators too. But if the system out there is not certain, how can we be sure? We just want to create certainty, to ask about legal certainty," said David Bayu at the Demajors office, Wednesday (12/3/2025).

The former vocalist of NAIF emphasized that musicians do not refuse to pay royalties. However, they need a clear system so they do not feel disadvantaged."Even if this is indeed the case, we will comply with the law. But if it is still uncertain and there are random accusations here and there, we also feel uneasy about it," he continued.

According to him, the lack of clarity in regulations makes many singers hesitant to accept performance offers. They are worried about facing legal issues if they do not understand the applicable rules.

Furthermore, David emphasized that singers never intend to take the rights of song creators unilaterally. They also understand the importance of sharing copyright fairly.

"And we as singers or performers have no reluctance at all to share copyright, or there is no, what is the term, not a bit - to put it bluntly. ‘I don’t want to pay.’ There is none, we are also creators. I am a singer and also a creator, I feel that way too," he explained.

THE VISION together with other musicians is still waiting for clarity on the regulations from the Copyright Law. They are open to the Constitutional Court's decision, as long as there is legal certainty for all parties.

"If there are indeed rights that we must uphold, then the system must be clear. That is what we need. So for a way out or to perform or whatever, there shouldn't be any unrest or uncertainty. Just the certainty," added David.

Previously, 29 musicians including David Bayu have filed a judicial review of the Copyright Law to the Constitutional Court. VISI also explained that the main point of this application is the clarity of regulations regarding royalty payments and the definition of copyright users in the applicable law.
