The Tangerang District Court held the first hearing of the tabung tanah investment case with Ustaz Yusuf Mansur as the defendant, on Tuesday (18/1/2022). From observations, Ustaz Yusuf Mansur did not attend and was only represented by his lawyer. Meanwhile, the plaintiffs, who are Indonesian Migrant Workers (TKI) in Hong Kong, namely Suratih, Aida Alamsyah, and Yeni Rachmawati, also did not attend and were only represented by their lawyers.

During the first hearing, the Panel of Judges verified the data. Then, they scheduled mediation for both parties.

"In the mediation process, it takes 30 days. If the time is not enough, it can be extended for another 30 days," said Sih Yuliarti as the Chief Judge in the trial.

In the mediation, the Judge requested Ustaz Yusuf Mansur as the defendant and the plaintiff to be present. If they do not attend twice in a row without reason, sanctions will be imposed.

"The principals are required to attend. If they do not attend twice in a row without reason, it will be considered as acting in bad faith and the mediator will recommend to the Judge panel to dismiss the lawsuit," said Judge Sih Yuliarti.

"The same goes for the defendant, if they do not attend twice in a row, they will be punished with the return of mediation costs," continued the Judge.

In response to the judge's request, Ariel Muchtar, as the lawyer for Ustaz Yusuf Mansur, said he would act cooperatively.

"If he (Ustaz Yusuf Mansur) is present, alhamdulillah, if he is not present, we will see later. But we will definitely cooperate," said Ariel Muchtar.

The lawsuit regarding the land savings investment filed by Suratih, Aida, and Yeni started when Yusuf Mansur gave a lecture in Hong Kong in 2014.

"Our clients were invited to the religious gathering. Then the ustaz talked about the values of charity. He then offered the land savings investment and they were interested," said Asfa Davy Bya, the plaintiff's legal representative.

However, after depositing a sum of money, the three plaintiffs were disappointed. Because what Yusuf Mansur said at that time was not as expected.

The invested money is unclear in its management and they also do not know the location of the purchased land.

The three plaintiffs, according to Asfa, have tried to ask directly for clarification from Ustaz Yusuf Mansur. But they were never responded to.

"The loss amount is in the hundreds of millions. So after they invested, they were given a website, email, and phone number. But there was no response. They even asked for a meeting and sent a summons, but it was also not responded to," said Asfa.

In their lawsuit, the three Indonesian migrant workers in Hong Kong asked Ustaz Yusuf Mansur to return the invested money and the promised profit, as well as the immaterial losses.

"We demand the return of the principal investment and the profit, as well as the immaterial losses," said Asfa.
