Adam Deni's Trial Resumes, Here is the Expert IT Witness Testimony

Kapanlagi.com - The continuation of the case of alleged violations of the ITE Law involving Adam Deni was held again at the North Jakarta District Court on Monday (25/4). This time, the agenda of the hearing was to listen to expert witnesses on ITE who were presented by the public prosecutor (JPU).

There were two expert witnesses presented in this hearing. One of the witnesses, Denden Imadudin Soleh, stated in his testimony that Adam Deni had violated one of the articles in the ITE Law.

"After studying it, it is more accurate that only in Article 32 of the ITE Law it transmits electronic documents so that confidential information is revealed," said Denden.

1. The Difference Between Documents and Information

Denden stated that there is a difference between documents and information. According to him, a document contains information. It could be that someone who holds a document is not the owner of the information contained in the document. Therefore, the holder of the document does not have the right to spread that information to others.

"In the ITE Law, there is information and electronic documents. The document is the container and the information is the content. It could be that the document belongs to me, but I still do not have the right to spread the information in it to others," he explained.

2. Adam Deni Violates the Law

As is known, this case began when Adam Deni uploaded the document of Ahmad Sahroni's bike purchase to social media. Not accepting his personal document being uploaded to social media without permission, Ahmad Sahroni reported Adam Deni.

"That data belongs to X (Ahmad Sahroni). X and A (Ni Made) conducted a transaction. A handed the data to B (Adam Deni) and B uploaded it to social media without X's approval. If it's without approval, it's a violation," said Denden.

Adam Deni and Ni Made Dwita were charged with Article 48 Paragraph (3) jo Article 32 Paragraph (3) of Law Number 11 of 2008 concerning Electronic Information and Transactions, as amended and supplemented by Law Number 19 of 2016 jo Article 55 Paragraph (1) ke-1 of the Criminal Code.

Meanwhile, Adam Deni, who was met after the trial, did not want to comment much and handed everything over to his legal counsel. He will also focus more on the Corruption Eradication Commission (KPK), which now welcomes the information report disseminated by Adam Deni.

"The trial response is still normal, so that everything remains open, the important thing is that my focus is also on reporting to the KPK. My lawyer also told me earlier that the KPK has called several times, so all my strategies have been handed over to my legal counsel," said Adam Deni.

4. Reviewed

"The information we provided has received a response from the spokesperson of the KPK. He appreciates the community's concern for efforts to prevent corruption. It is currently being reviewed," said Herwanto, Adam Deni's legal representative.
