Call Somasi Posan Tobing Unfounded, Band Kotak: Even Without Somasi, We Won't Sing

Kapanlagi.com - The band group Kotak responded to the open somasi filed by their former drummer, Posan Tobing. According to them, the issue of Kotak's name being recognized as Posan's property is unfounded because they were formed from a talent search event.

"First, in accordance with their somasi, they claim that Kotak is considered Posan's property, and we need to convey to some people that Kotak emerged from a talent search event called Dream Band by Hai Musik," said Sheila A. Salomo, Kotak's legal representative, in a press conference in Central Jakarta on Wednesday (26/7/2023).

"In that event, the name Kotak was formed with the approval of the personnel from Hai Musik. Then Kotak's management was transferred to the current party, Warner Music," she added.

1. Posan Still a Member of Kotak

During the transition, Posan was still a member of the band Kotak. Only after that did Posan resign and there were no issues afterwards.

"When we met with Posan's lawyer and Julia, we did convey that there may be differences of opinion. Yes, we are open for discussion but after receiving the open summons, we have to state our legal position that we reject the idea that Kotak belongs to Posan and Julia," he said.

2. Never Perform Songs Composed by Posan

Secondly, regarding the use of songs composed by Posan and Julia. Kotak's side asserts that they have never performed their songs again.

"The second issue from this open summons, beyond the legal position regarding who has the obligation to pay royalties, we need to convey that there is no need for a ban on Posan's songs, because for a long time Kotak has not wanted to perform those songs," he explained.

3. Unfounded Somasi

Therefore, Kotak personnel mentioned that the open somasi sent by Posan and Julia is unfounded. And they also object to Posan's prohibition on the song they created together.

"So, even without a somasi, the song is no longer sung. But regarding their somasi about the songs created together at that time, we have to express our stance, that we object to the prohibition of the song. We are the creators too," he concluded.

The jointly created songs that are also prohibited are Masih Cinta (created by Pay Burman, Dewiq, Posan, Cella, and Tantri), Kosong Teojoeh (created by Pay Burman, DewiQ, Posan, Cella), Tinggalkan Saja (created by Pay Burman, DewiQ, Posan, Cella), Pelan-Pelan Saja (created by Pay Burman, DewiQ, Tantri, Cella, and Chua), and Selalu Cinta (created by Pay Burman, DewiQ, Posan, Cella, and Tantri).
