Olivia Nathania's Legal Counsel Will Bring Nia Daniaty as a Mitigating Witness

Kapanlagi.com - South Jakarta District Court held another hearing on the alleged fraud case of CPNS with the defendant Olivia Nathania, Monday (7/3/2022).

In the hearing held around 13.45 WIB, the Public Prosecutor presented 6 witnesses.

Four witnesses are other defendants in the same case who were presented virtually, namely Fiky Muliandhany alias Kiki, Rosita, Eki Saputra, and Sigit.

Meanwhile, the other two witnesses were present in the courtroom, namely Agung Prajogo, a representative from the Indonesian State Personnel Agency (BKN RI), and Yasinta Asih, director of sales & marketing at Hotel Bidakara.

1. Continuation of the Hearing

After listening to the testimony from the Prosecutor, the Panel of Judges scheduled a continuation of the trial on Thursday (10/3/2022).

In the upcoming continuation of the trial, the Panel of Judges will give Olivia Nathania's legal counsel the opportunity to present mitigating witnesses.

2. Presenting Nia Daniaty

When asked about the witnesses to be presented, Olivia's legal counsel, Andy Mulia Siregar, plans to present Nia Daniaty.

"We want to present 3 witnesses. Hopefully, her mother will agree. After all, Olivia Nathania is her daughter," said Andy Mulia Siregar after the trial.

3. Mitigating Olivia's Sentence

He hopes that with Nia Daniaty's testimony, it can lighten the punishment for his client or perhaps even free Olivia from the charges.

"Well, they have a mother-daughter relationship. There must be some confiding," he said.

4. Possibility of Other Witnesses

Apart from Nia Daniaty, Andy has not been able to confirm other witnesses who will be presented. Because the time given by the Panel of Judges is considered very short.

"We will try to find. Because we were only given 3 days. Whereas the Prosecutor's Office was given 3 months," said Andy.

5. Threat of Punishment

As known, Olivia Nathania was officially detained by the Jakarta Metropolitan Police on November 11, 2021, regarding allegations of embezzlement, forgery of documents, and fraud against 225 Civil Servant Candidate (CPNS) with an estimated total loss of Rp 9.7 billion.

In the trial, Olivia Nathania was charged with Article 263 in conjunction with Article 65, Article 378 in conjunction with Article 65, and Article 372 in conjunction with Article 65 regarding embezzlement, forgery of documents, and fraud with a threat of 4 years imprisonment.
