Performing the song 'Bintang' and Accused of Changing the Composer's Name, Tina Toon and others are sued for Rp 10.7 billion

Kapanlagi.com - The singer of the song Bolo Bolo, Tina Toon has been sued for Rp 10.7 billion at the Central Jakarta Commercial Court. The lawsuit was filed by a man named Engkan Herikan, who is a songwriter.

He did this because he disagreed with his song titled Bintang which was popularized by the band Anima being sung by Tina Toon without Engkan Herikan's knowledge. Moreover, the song was also remade by her label, changing the name of the songwriter.

"So it is true that we represent our client, Engkan Herikan, has filed a lawsuit for unlawful acts at the Central Jakarta Commercial Court against several people," said Engkan Herikan's lawyer, Muhammad Iqbal Arbianto, when met in the Kuningan area, South Jakarta, on Friday (27/8).

"Basically, our client feels disadvantaged because the song created by our client, namely the song Bintang and popularized by the band Anima, was performed and the name of the songwriter was changed. Our client, Engkan Herikan, should have been changed to another party's name," he continued.

The lawsuit was filed with case number 23/Pdt.Sus-HKI/Cipta/2021/PN Niaga Jkt.Pst. Engkan Herikan filed the lawsuit in April 2021. In addition to Tina Toon, several parties were also sued by Engkan Herikan, including Basia Roullete, Baros Roulette, Ian Juanda, Andri Anima, Universal Music Indonesia, Sony Music Indonesia, and WAMI.

"So there are several parties being sued. The first one is Basia, then Baros Roulette, Pak Ian, one of the members of the Regional People's Representative Council Agustina Hermanto (Tina Toon), Andri, Universal Music, and Wahana Music," said Muhammad Iqbal Arbianto.

Muhammad Iqbal Arbianto mentioned that Tina Toon was also reported because she performed the song. Other names were also dragged into it because they changed the name of the song's creator.

"We also sued Tina Toon because she performed the song. As for the labels, we have contracts with them, but there have been changes in the name of the creator. So we included them in the lawsuit. So for Tina Toon herself, we included her as a defendant to complete our lawsuit," he said.

2. Losses Incurred

Therefore, Engkan Herikan feels both material and immaterial losses. The amount of these losses is Rp 750 million and Rp 10 billion.

"So we as the plaintiff suffered from moral and economic rights. So our client is suing in the Central Jakarta Commercial Court with a nominal amount of approximately Rp 750 million for material losses and Rp 10 billion for immaterial losses," said Muhammad Iqbal Arbianto.

Meanwhile, up to now, the media is still seeking a response from Tina Toon regarding the lawsuit.
