The legal team has given Sandy a deadline of 3x24 hours to remove the photo. If not, they will take further legal action.

"Therefore, we request within 3 times 24 hours for the unauthorized edited photo to be taken down and circulated on Instagram rather than involving the concerned party," said Agustinus Nahak when met in the Senayan area, Central Jakarta, Monday (8/6/2026).

The editing of this photo has raised public speculation regarding Tessa's beliefs, which is considered a sensitive issue. Tessa feels her privacy has been violated and views Sandy's actions as a publicity stunt.

"Such actions can be prosecuted; there are four laws being violated. The first is the Criminal Code, the second is the ITE Law, the third is the Data Protection Law, and the provisions of the Copyright Law," he said.

4. Do Not Want to Be a Bad Example

Tessa Kaunang does not want such arbitrary actions to be emulated by the wider internet-using community. For her, spreading manipulated photos is a form of misinformation that harms her reputation.

"Editing someone else's photo or video without legitimate permission is an unlawful act and can be classified as a criminal offense. Especially if the results are disseminated, it distorts, violates privacy, and misleads the public," she asserted.

5. Threat of Punishment

The criminal threat awaiting Sandi is classified as very severe because it involves fines amounting to billions of rupiah. This case began when Sandi uploaded an edited photo of Tessa Kaunang wearing a hijab without the original owner's permission.

"So, the criminal threats vary, it can be light or it can be heavy, reaching a prison sentence of 12 years and fines of billions of rupiah," he said.

6. Verdict and Detention

If the post is not deleted within three days, the legal team will take more severe criminal action. They want to provide education so that no party misuses digital space freely.

"We reiterate that the act of editing itself is not a crime, but it becomes illegal when disseminated without permission, without the rights of the photo's owner," he concluded.

In addition to the photo issue, Sandy Tumiwa was also embroiled in a case of fraudulent investment that occurred in 2015. He was arrested after being reported by several victims.
