Kapanlagi.com - The divorce lawsuit filed by Ruben Onsu against Sarwendah at the South Jakarta District Court is facing obstacles, due to the issue of the defendant's incorrect residential address. This problem has resulted in the lawsuit process being unable to proceed further.
Ruben Onsu's legal representative, Minola Sebayang, explained that since the initial registration of the lawsuit, they have ensured that the address provided is in accordance with the data stated on Sarwendah's identification card.
"The address we provided is actually in accordance with the one on Sarwendah's identification card," said Minola Sebayang at the South Jakarta District Court on Tuesday (23/7/2024).
Sarwendah has received the first summons from the court to attend the hearing. However, she chose not to attend in person and preferred to send her legal representative.
"The first summons from the court has been successfully delivered to Sarwendah and is considered valid by the judges," said Minola Sebayang.
However, there was a problem with the subsequent summons. The summons always returned to the court because the stated address was incorrect.
"After the second summons, the defendant did not receive the summons, so it was returned to the court," said Minola Sebayang.
Today, Ruben Onsu finally updated Sarwendah's address in their lawsuit. With the latest address obtained, it is hoped that the summons process can proceed smoothly.
"We have obtained the new address of the defendant's domicile and will immediately inform the court of the address change," said Minola Sebayang.
Ruben Onsu's party hopes that with the updated address that has been provided, the summons process can be continued promptly.
"Hopefully, with this, the summons can reach the defendant. Then it is up to the defendant to decide whether to attend or not," explained Minola Sebayang.
Although officially summoned, if Sarwendah chooses to remain absent from the hearing, the divorce lawsuit process of Ruben Onsu can be processed faster.
"If she doesn't appear, the court proceedings are already valid. So, this divorce process can proceed more quickly without lingering on the issue of summons," concluded Minola Sebayang.
