Not for Imprisonment, Apparently This is the Reason Lesti and Rizky Billar Reported to the Police

Kapanlagi.com - Mila Machmudah Djamhari's plan to sue Rizky Billar and Lesti seems to be serious. The former official of the National Mandate Party (PAN) DPW East Java, along with her lawyer, Edi Prastio, claimed to have consulted with the East Java Regional Police regarding the articles that can be applied to prosecute Rizky Billar and Lesti.

"We have consulted with the Regional Police regarding the articles and we have to file a report. For our report, we are directed to the Jakarta Metropolitan Regional Police or the Tangerang Police Resort," said Mila Machmudah virtually, on Friday (1/10/2021).

Edi Prastio stated that he has prepared two articles to be used in prosecuting Rizky Billar and Lesti. "We are using Article 242, which is about giving false statements. And also Article 266, which is about forging documents in the marriage certificate. (For the report) Maybe next week," added Edi Prastio.

Mila further stated that her intention to report Rizky Billar and Lesti is not to imprison the couple. But it is to educate the public about secret marriages.

"My reason for going through the legal process is to provide legal certainty within the community about the correct way of marriage, whether it should be done twice or once (ijab kabul). I have no intention whatsoever to prosecute or imprison," said Mila.

"Educating, not imprisoning because there is a legal restoration," added Edi Prastio.

1. Hoping Lesti and Rizky Billar Apologize

According to Mila Machmudah, based on her knowledge of Islamic law and positive law in Indonesia, conducting the marriage proposal (ijab kabul) twice must go through the process of isbat in the Religious Court, not directly to the Office of Religious Affairs as done by Billar and Lesti.

"Because in Islamic law and positive law in Indonesia, there is no provision for conducting the marriage proposal twice. Even if there is, the scholars who permit it have weak evidence. Because the statement of the scholars states that conducting the marriage proposal twice is not allowed. Including the institution of Bathsnul Masail PWNU Jatim, which states that a secret marriage is legally formalized through isbat. This is where I have a problem," she said.

Mila Machmudah also suggested to Billar and Lesti, as well as the television that broadcasted their marriage, to apologize.

"We hope that there will be sincerity from Lesti - Billar or the TV media to acknowledge or apologize. The main point is to acknowledge the mistake. By doing so, it will become a continuous good deed because their acknowledgment of their mistake will enlighten many people that this is the proper way to conduct a secret marriage," said Mila.
