Kapanlagi.com - The Indonesian Composers Association (AKSI) has finally spoken out regarding Agnez Mo's statement about the elements of greed in the copyright lawsuit filed by Ari Bias. This case began from the use of the song Bilang Saja in three concerts without the creator's permission, which resulted in a court ruling in favor of Ari Bias.
The Chairman of AKSI, Piyu 'Padi', expressed surprise upon hearing Agnez's statement that mentioned greed. According to him, Ari is only fighting for his rights as a song creator, which he has not received until now.
"We want to know what kind of greed is meant. Each party has its own share. The performers have their share, while the song creators do not receive their fair share," said Piyu when met in the Fatmawati area, South Jakarta, on Monday (17/2/2025).
Piyu explained that in the music industry, the division of rights is clearly regulated. He emphasized that song creators have their own share that must be respected.
"That's why we want to know how greed is defined, because everyone already has their own share," he said.
In addition to responding to Agnez Mo's statement, AKSI also expressed support for the decision of the Central Jakarta Commercial Court that ruled in favor of Ari Bias. The ruling stated that Agnez was proven to have violated copyright by performing the song Bilang Saja without permission from its creator.
According to Piyu, this decision is in accordance with the applicable legal provisions. He hopes that all parties can accept the ruling and respect it as a result of a legitimate legal process.
"We also respect the cassation efforts made by Agnez Mo and her legal team," said Piyu.
Furthermore, he emphasized that AKSI has consistently fought for the rights of song creators from the beginning. According to him, this ruling serves as evidence that song creators have exclusive rights that must be fulfilled by those who wish to perform their works.
"From the beginning, AKSI has strongly voiced our opinion about the Copyright Law in line with this ruling, namely the exclusive rights of the creator," he said.
On the other hand, the Chairman of the AKSI Board of Trustees, Ahmad Dhani, also responded to this case. He highlighted the distribution of royalties, which he deemed unfair, particularly in the case of the song Bilang Saja. Dhani mentioned the income Agnez Mo has received from the song since 2014, while its creator, Ari Bias, has received nothing.
"Later ask Agnez, how much has she earned from the song created by someone else from 2014 until now? And how much has the song creator received?" "That’s zero," said Dhani.
According to Dhani, this condition reflects the disparity in royalty distribution in the music industry. He hopes this court ruling can serve as an important reminder that the rights of song creators must always be respected.
Meanwhile, on the other side, Agnez Mo through her legal team stated that she will file a cassation against the ruling. In the decision issued on January 30, 2025, the panel of judges ruled that Agnez violated the Copyright Law and must pay a fine of IDR 1.5 billion. The fine is an accumulation from three concerts held in May 2023.
Here are the details of the concerts in question: May 25, 2023 HW Superclub Surabaya – IDR 500 million. May 26, 2023: H-Club Jakarta – IDR 500 million. May 27, 2023: HW Superclub Bandung – IDR 500 million. The court decided that in these three concerts, Agnez performed the song Bilang Saja without the permission of the songwriter, Ari Bias.
Piyu hopes this ruling can serve as a valuable lesson for all players in the music industry. According to him, respecting copyright is not only a legal obligation but also a form of appreciation for songwriters who have created works.
"We hope all parties can respect this ruling. If they really want to file a cassation, that is their right. But, the point is, songwriters must receive their rights according to the applicable regulations," concluded Piyu.
