Chronology Portrait of the Land Dispute Between Atalarik Syach and Dede Tasno, Since 2015 - Ending with Execution

Eka stated that Atalarik does not have a strong legal basis for the ownership of the land. Atalarik's claim to the land is considered baseless because he lacks material rights."Yes, initially it was indeed a dispute. Our client does not have material rights, but has rights to this land. So, he has lost his rights to this land. If he wants to use it, it must go through legal efforts in court," he revealed.

During the trial process, Atalarik submitted a sale and purchase deed as evidence. However, Eka said that the document has been declared invalid by the court."Indeed, the story is long, from 2015 until now, Atalarik's party claims that he has owned this land based on the sale and purchase deed. Which we have proven in court, we have also made legal efforts, we proved that the AJB was indeed fake," explained Eka.

Eka added that none of the parties in the sale and purchase deed could show valid proof of ownership. This is a strong basis for legally suing Atalarik."The parties involved in the AJB cannot prove that this land has clear rights or clear standing regarding this land," he added.

The area of the disputed land also changed in the official measurement documents. Although it was initially recorded as 7,800 square meters, the latest measurement results showed only 5,880 square meters."Yes, so the actual area of this land is 7,800 m2 owned by our client based on the 2021 Constructing MAP. This is the latest Plotting MAP, which is 5,880 m2," he explained.

Eka said that before the execution was carried out, his side had opened a communication channel. However, no agreement was reached with Atalarik Syach."Our communication was actually not just one-way. So we, in civil law, tried to seek a win-win solution first. But up to this moment, there has been no legal certainty regarding what Atalarik wants. Therefore, we are making efforts for execution," he explained.

For almost ten years, Dede Tasno's side has gone through all the applicable legal processes. Starting from the first-level court, appeal, to judicial review.

"So indeed we won in... in our civil case we won. There was an appeal, there was a cassation effort, there was a judicial review effort. We have passed all of that," said Eka.

Eka emphasized that the execution is carried out after there is a final and binding decision from the court. Without that, the court will not carry out the execution.

"Of course, if we submit a request for execution, the decision must be final or have permanent legal force. So the court will not want to carry out execution efforts without a clear legal basis," he concluded.
