Facilitating Others to Commit Obscene Acts, Cynthiara Alona Sentenced to 10 Months in Prison

Kapanlagi.com - The trial of the alleged prostitution case involving the defendant, artist Cynthiara Alona, has reached its final stage. In the trial held on Wednesday (8/12/2021), the Panel of Judges ruled that Chyntiara Alona was guilty of violating Article 296 of the Criminal Code.

"Declares the defendant Cut Cynthiara Alona guilty of intentionally facilitating lewd acts by others as stipulated in Article 296 of the Criminal Code," said the Panel of Judges.

Therefore, the Panel of Judges, consisting of one Chief Judge and two Associate Judges, unanimously sentenced Cynthiara Alona to 10 months in prison. "Imposing a sentence on Cut Chyntiara Alona with a prison term of 10 months, reduced by the time already served in detention,"

1. Considering Several Factors

The decision was made after the Panel of Judges considered several aggravating and mitigating factors.

"The aggravating factor is that the act violated the existing norms in society, especially religious norms, and the mitigating factor is that the defendant behaved politely during the trial, cooperated in providing testimony, had no previous convictions, received medical treatment for her illness, and admitted her actions," said the Panel of Judges.

Previously, Chyntiara Alona was sentenced by the Public Prosecutor to six years in prison and a fine of Rp200 million or six months in prison. As it is known, Chyntiara Alona was arrested along with two other individuals, namely Abdul Ajiz and DA, in March 2021 for allegedly engaging in child prostitution practices conducted at Hotel Alona in the Ciledug area, Tangerang, Banten.

The three of them were charged under Article 88 in conjunction with Article 76 Letter I of Law Number 23 Year 2002 concerning Child Protection.

3. Designated as a Suspect

The reason Alona was designated as a suspect is because she was aware of her business as a prostitution venue. There are two pieces of evidence that directly place her in that position.

"Yesterday someone asked, what is the context of CA being designated as a suspect. Here, she is directly aware. There are two pieces of evidence that we have obtained to designate the person as a suspect and carry out detention," said Yusri Yunus, the Head of Public Relations of the Jakarta Metropolitan Police, during a press conference on Friday (19/3/2021).

4. Involve Underage Children

The fact that further burdens Cynthiara Alona, the perpetrator of prostitution who is later called a victim, is that on average they are still underage. She works together with a pimp with the initials DA and a manager with the initials AA.

"We agree to call these 15 people victims because they are all underage children with an average age of 14 to 15 years old. The hotel management, both the owner and the manager, provide a place and even know that the children who go there do not need to use an ID card," Yusri continued.

5. Economic Problems as an Excuse

Cynthiara Alona made her business location in the Kreo area, Tangerang, as a place for prostitution due to financial reasons. The illegal practice has been admitted to be carried out for the past three months.

"The motivation is economic problems. She saw that the COVID-19 situation made hotels empty, so she facilitated one way. But it is wrong to provide online prostitution in her place," explained Yusri.
