Formerly Sued by Laura Anna's Family as Compensation for the Future of the Deceased, Gaga Muhammad's Mother Admits Not Knowing the Exact Amount

Kapanlagi.com - Before entering the trial, Gaga Muhammad was somated by Laura Anna's family for Rp. 12.6 billion. The amount is for the compensation of Laura Anna's future until she turns 60 years old.

Gaga Muhammad's mother, Janariyah, admitted that she did not know the details of the 12.6 billion somation demanded by Laura Anna's family.

"The demand for 12.6 billion, I don't know how to calculate it, you should ask the one who demands 12.6 billion. What is clear is that we received a demand of 12.6 billion. I didn't bring a calculator, so I can't calculate the details and how to calculate it," said Janariyah at the East Jakarta District Court on Tuesday (8/2/2022).

1. Already Finished

Because Gaga Muhammad has been imprisoned, Janariyah mentioned that the somation sent by Laura Anna's family is already finished. However, if they have any objections regarding this matter, Janariyah actually welcomes Laura Anna's side to sue.

"Now it's already finished, it's already in this court. Now we have entered a new issue, so I think there is no need to demand it anymore. If they have any objections from their side, please go ahead," she said.

2. Disclaim Responsibility

Previously, Gaga Muhammad was accused of disclaiming responsibility for the accident that happened to Laura Anna in 2019. Janariyah said that Gaga Muhammad also tried to help cover the medical expenses for Laura Anna after the accident in December 2019.

"If we talk about the assistance at Mayapada Hospital, Laura's parents conveyed to Gaga, 'Ga, how is this? We have to pay the hospital bills.' Then Gaga said, if my family can't help yet, but I will find a way to solve it," said Janariyah.

"He (Gaga Muhammad) will communicate with his friends and he received assistance at that time, around Rp 180 million and Rp 40 million to Mayapada. The Rp 140 million went directly to the late Laura's mother's account," Janariyah concluded.

3. Submit an Appeal

Mother of Gaga Muhammad, Janariyah, and her lawyer, Fahmi Bachmid, submitted an appeal memorandum to the East Jakarta District Court on Tuesday (8/2/2022). It is known that Gaga Muhammad was sentenced to 4.5 years in prison in a traffic accident case.

Janariyah stated that the 4.5-year prison sentence imposed by the judge of the East Jakarta District Court on Gaga Muhammad is considered too heavy. Because of this sentence, Janariyah filed an appeal against the judge's decision.

"Oh yes, that's why we filed an appeal," said Janariyah at the East Jakarta District Court on Tuesday (8/2/2022).

4. Lighten the Sentence

At least, the appeal efforts made by Janariyah can lighten the sentence for Gaga Muhammad. For Janariyah, the punishment for her son is still too heavy.

"At least Gaga gets justice, because he is still too young so he deserves justice. At least the punishment is reduced," she said.

5. Related to the Cause of the Late Laura Anna's Paralysis

In this appeal, Fahmi explained that there are eight points raised by Gaga Muhammad. The first point is related to the cause of the late Laura Anna's paralysis.

"I am only providing the illustration, the essence of it is that there are 8 reasons for filing an appeal. The first reason is that there is an error in concluding that the victim, Laura Anna, became paralyzed on December 8, 2019. Here is the first reason, there was an error in making it seem like Laura became paralyzed on December 8, when in fact it is not like that," said Fahmi.

"The second reason is that there is an error in seeing the paralysis as a result of Gaga Muhammad's actions, so Gaga Muhammad was negligent, yes. But causing paralysis has not been proven in this trial," Fahmi continued.
