Kapanlagi.com - The case of alleged corruption involving Harvey Moeis, the husband of artist Sandra Dewi, has reached a new chapter. The public prosecutor (JPU) has charged Harvey with a prison sentence of 12 years.

The indictment was read during a session at the Jakarta Corruption Court on Monday (9/12/2024). Harvey Moeis was found guilty of committing a corruption crime related to tin trading.

"We impose a prison sentence on the Defendant Harvey Moeis for 12 years, reduced by the time the defendant has been in detention, with an order to remain detained in the detention center," said the prosecutor while reading the indictment at the Jakarta Corruption Court on Monday (9/12/2024).

In addition to prison sentences, Harvey is also required to pay a fine of Rp 1 billion. If he is unable to pay the fine, a one-year prison sentence will be served instead.

Not only that, Harvey is burdened with compensating the state for losses amounting to Rp 210 billion. This provision allows one month after the decision has permanent legal force.

If the replacement money is not fulfilled within the deadline, his assets will be seized and auctioned off.

"The defendant does not have sufficient assets to pay the replacement money, so he is replaced with a prison sentence of 6 years," said the prosecutor.

In reading the indictment, the prosecutor revealed several aggravating factors. One of them is that Harvey's actions are considered not supportive of the government's program to eradicate corruption, collusion, and nepotism.

"The defendant's actions have caused significant financial losses to the state, amounting to Rp 300 trillion," he said.

In addition, Harvey is also said to have benefited himself by Rp 210 billion. Another point highlighted is Harvey's attitude during the trial.

The prosecutor stated that Harvey was evasive when giving testimony. However, there is one mitigating factor, namely that Harvey has never been convicted before.

"There are also mitigating factors to consider, namely that the defendant Harvey has never been convicted before," said the Prosecutor.

The Prosecutor based his charges on Article 2 paragraph (1) in conjunction with Article 18 of the Anti-Corruption Law in conjunction with Article 55 paragraph (1) number 1 of the Criminal Code.

In addition, Harvey was also charged with violating Article 3 of Law Number 8 of 2010 concerning the Prevention and Eradication of Money Laundering Crimes (TPPU).
