Harvey Moeis Considers Appealing After Being Sentenced to 6 Years and 6 Months in Prison and a Fine of 1 Billion

Kapanlagi.com - The corruption case of artist Sandra Dewi's husband, Harvey Moeis, has finally received a verdict from the panel of judges at the Jakarta Corruption Court. He was sentenced to 6 years and 6 months in prison and a fine of 1 billion subsider due to being proven guilty of the tin corruption case or abuse of business license for managing the area of PT Timah (Persero) Tbk.

"The court judges, imposes a prison sentence of 6 years and 6 months on the defendant Harvey Moeis, and a fine of Rp1 Billion subsider 6 months in prison," said Chief Judge Eko Aryanto in the courtroom, Monday (23/12/2024).

Harvey Moeis was proven to have committed corruption in collaboration and money laundering crimes in collaboration. It should be noted that this sentence is lighter than the demand from the public prosecutor (JPU) in the alleged tin corruption case against Harvey Moeis, which was 12 years in prison.

1. Must Pay Replacement Money of 210 Billion

Not only that, Harvey Moeis was also ordered by the panel of judges to pay replacement money amounting to Rp210 billion, no later than one year after the court decision becomes legally binding. Consequently, if within that period the defendant does not pay the replacement money, then his assets will be seized by the prosecutor and auctioned off to cover the replacement money.

"Imposing the defendant to pay replacement money of Rp210 billion, with the provision that if the defendant cannot pay the replacement money within one month after the decision has legal force, then his assets may be seized and auctioned to cover the replacement money," said the public prosecutor.

However, if the defendant does not have sufficient assets to pay the replacement money, he will be sentenced to 2 years in prison.

The panel of judges found that Harvey Moeis had violated Article 2 Paragraph (1) in conjunction with Article 18 of Law Number 31 of 1999 concerning the Eradication of Corruption Crimes as amended by Law Number 20 of 2001 in conjunction with Article 55 paragraph (1) number 1 of the Penal Code and Article 3 of Law Number 8 of 2010 concerning the Prevention and Eradication of Money Laundering Crimes in conjunction with Article 55 number 1 of the Penal Code.

"To demand, to state that the defendant Harvey Moeis has been proven legally and convincingly to have committed the crime of corruption and the crime of money laundering as stated in the primary indictment Article 2 paragraph (1) in conjunction with Article 18 of the Anti-Corruption Law in conjunction with Article 55 paragraph (1) number 1 of the Criminal Code and Article 3 of Law No. 8 of 2010 concerning the Prevention and Eradication of Money Laundering in conjunction with Article 55 number 1 of the Criminal Code," continued the public prosecutor while reading the indictment on Monday (9/12/2024)

"To impose a prison sentence on the defendant Harvey Moeis for 12 years, reduced by the time the defendant has been in detention with a permanent detention order. The prosecutor also demanded that the panel of judges impose a fine of Rp1 billion on Harvey Moeis, with the provision that if it is not paid, it will be replaced with a prison sentence of 1 year. Not to forget, there is also a demand for replacement money in detention," he explained.

Regarding this decision, Harvey Moeis's side through his legal team stated that they will think carefully first about whether to file an appeal or not.
