Legislator Requests Restorative Justice in the Case of Nia Ramadhani and Ardi Bakrie

Kapanlagi.com - The case of Nia Ramadhani and her husband, Ardi Bakrie, related to drugs and imprisonment, has attracted the attention of members of parliament, including members of the DPR from Commission III who held a meeting with the National Narcotics Agency (BNN).

Yes, Sari Yuliati, a member of Commission III of the Indonesian House of Representatives from the Golkar Party Faction, also criticized the prison sentence against Nia Ramadhani and Ardi Bakrie in relation to the drug case.

It is known that they were sentenced to one year in prison. Sari requested the implementation of restorative justice in this case.

“In this case, the implementation of restorative justice by seeking alternative punishment without imprisonment in accordance with the law. They are just addicts, and according to the law, rehabilitation should be sufficient,” said Sari in a meeting with the Head of BNN in the DPR Commission III room.

1. Consideration

Sari explained that the overcrowded prison is a consideration for every drug addict, as if they are not imprisoned.

“There is no need for such actions, especially since we all know the problem of overloaded prisons that has not found a significant solution,” she said.

2. Concerned about Prison Sentences

In addition to Sari, Gerindra Party politician Habiburokhman is also concerned about the prison sentences for Nia and Ardi.

“Yes, we are concerned, like yesterday's case with Ardi Bakrie, it is clear that he is a user. But the punishment should not be imprisonment," he said in the meeting.

Habiburokhman highlights the difference in sentences for users, dealers, and drug traffickers. The Head of BNN, Komjen Petrus Reinhard Golose, who was present, was seen listening attentively. 

"Scientifically, this is not appropriate in our opinion. According to me, the law enforcement officers may not understand the details, they are not enlightened yet," said the Gerindra Party politician.

4. There Must Be Differences

According to Habiburokhman, there should be differences in punishment between users, dealers, and traffickers.

Moreover, what Nia and Ardi Bakrie experienced, he said, is very rampant in the country.

5. According to Forensic Psychologist

Meanwhile, forensic psychologist Reza Indragiri Amriel mentioned that there is a most dangerous effect if drug defendants are imprisoned instead of rehabilitated. Reza commented on the one-year prison sentence decided by the panel of judges of the Central Jakarta District Court for Nia Ramadhani and Ardi Bakrie.

“By disregarding rehabilitation at one level, including the initial level, it is risky to push N and A into higher levels of severity. Moreover, if we observe, prisons have become places for parties and even drug factories. Without rehabilitation, how can drug inmates become immune?” said Reza in Jakarta, Monday, January 17, 2022.
