Nikita Mirzani is Sick, Files Have Not Yet Been Transferred to the Prosecutor's Office

Kapanlagi.com - Nikita Mirzani's detention status has not yet been transferred to the prosecutor's office. Although her case files have been declared complete, the second stage of transfer has not been conducted due to her health condition, which is said to be not allowing it.

The Head of Public Information Section of the DKI Jakarta Prosecutor's Office, Syahron Hasibuan, stated that Nikita's detention status is still under the authority of the investigator because there has been no official handover to the Public Prosecutor (JPU).

"If sick, the status is normally deferred by the investigator because until today there has been no transfer of detention from the investigator to the public prosecutor yet," said Syahron at the DKI Jakarta Prosecutor's Office on Monday (2/6/2025).

"Later, the transfer of detention will be from the time it is handed over or through the second stage, commonly referred to as the handover of the suspect and evidence, it will then transition to the custody of the public prosecutor and will be counted again later," he added.

However, Syahron admitted that he could not confirm since when Nikita has been undergoing treatment at the hospital. He emphasized that the prosecutor is currently still waiting for the investigator's readiness to carry out the second stage of the transfer.

"I can't confirm when, but I can ensure the information from the public prosecutor about when my colleagues plan to carry out the second stage," he stated.

2. Nikita's Condition is Not Yet Healthy

According to the latest information received by the prosecution, Nikita's condition is not yet healthy enough to undergo further legal processes. Therefore, the prosecutor cannot take further steps until the suspect is declared fit.

"The information from the investigator is that the suspect is still in a condition that is not fit. So we must ensure that he is fit first," he explained.

3. Extension of Detention Period

This situation directly impacts Nikita's detention period. As the transfer has not yet been carried out, the investigators have extended the detention for another 30 days starting from June 2 to July 2, 2025.

"There will be a detention, this will be extended again from June 2 to July 2, the latest information is 30 days (30 more days). That's correct," said Syahron.

4. Detention for the Next 30 Days

He cannot confirm whether this is the second or third extension of detention, but he emphasizes that the extension status has been legally implemented for the next 30 days.

"I can't confirm if it's the second or third extension from the court. But it is confirmed that the detention extension is valid. This is a 30-day detention extension," he said.

5. Depends on the Evaluation Results of the Suspect

If within the next 30 days Nikita still cannot be transferred to the prosecutor's office, there is still a possibility for the investigator to request an extension. This will depend on the evaluation results of the suspect.

"Whether there will be another extension of detention depends on what the investigator has. If there is, then it will be extended again," he said.

6. Prosecutor's Office Drafting the Indictment Letter

Syahron explained that the main reason for the extension of detention is so that the prosecutor's office can quickly draft the indictment letter. With the second phase of transfer, the prosecutor can directly submit the trial schedule to the court.

"The reason for detention since the P21 is that the public prosecutor hopes this will be transferred soon so that the prosecutor can facilitate the drafting of the indictment to be submitted to the court, request the trial schedule, request the determination of the panel and the trial day, which will expedite the trial process," explained Syahron.

7. Hoping the Process Goes Quickly

However, the suspect's health condition, which has not yet recovered, has caused everything to be postponed. According to him, both the investigators and the prosecutors certainly hope the process can proceed more quickly.
