Objection to Judge's Decision on Royalties, Virgoun Appeals

Kapanlagi.com - Singer Virgoun has filed an appeal after the panel of judges at the West Jakarta Religious Court granted Inara Rusli's divorce lawsuit on Friday, November 10, 2023. This was conveyed by Virgoun's legal representative, Wijayono Hadi Sukrisno alias Kris, at the South Jakarta Metropolitan Police on Friday (November 24, 2023).

"Today, November 24, 2023, if we count from Virgoun's decision on November 10, 2023, the deadline for filing an appeal is 14 days," said Kriss.

"So today we have submitted a legal appeal against the decision, we submitted it to the high court through the West Jakarta Religious Court, the case is being appealed," Kriss added.

Kriss revealed the reasons why Virgoun appealed against the divorce decision. According to him, there are several points that make his client object to the panel of judges' decision, one of which is related to royalty rights for songs.

"Because there are several things that we disagree with regarding the decision from the West Jakarta Religious Court, there are several things, three or four items, one of which is royalties, because there is no legal certainty," he said.

1. Shouldn't it be Granted?

Based on legal analysis, Wijayono believes that the royalty demand should not be granted because it involves a third party.

"According to our legal analysis, starting from when it is unknown, the object, the song title, there are several incorrect things," said Kriss.

"Royalties, on item eight, mention songs a,b,c, joint property, but it doesn't mention when it is counted. There is also a third party involved, so our view on royalties is included in the appeal," Kriss continued.

2. Only Involving 1 Expert Witness

Then Kriss explained that the panel of judges only referred to the testimony of one expert witness regarding royalties. The judges should also consider other references before issuing the verdict.

"If it were up to us, it would be better not to have rights, because it can be said to be inspiration or something, maybe the song 'Galunggung Meletus' is inspiration, where is the royalty for that?" he concluded.
