Rinoa Aurora Senduk Withdraws Report, Police Cannot Release Leon Dozan Yet

Susatyo Purnomo Condro appreciates the peace process that occurred between Leon Dozan's family and Rinoa Aurora Senduk, which led to the withdrawal of the report. However, this does not immediately result in the release of Leon Dozan from detention.

"No, there is a process. Restorative justice has a process, there is a police regulation number 8 of 2001 regarding the process of restorative justice when there is reconciliation between the complainant and the accused. We will study and analyze it later," said Susatyo at Central Jakarta Metro Police, Monday (4/12/2023).

According to Susatyo, in the process of restorative justice, there are two conditions that must be met by the accused party. 'In principle, the investigation process has already been carried out, then in the investigation process, seven days after conducting the investigation, we have sent a letter of instruction to start the investigation to the prosecutor's office, now if there is restorative justice, there are two conditions, formal conditions, and material conditions,' he said.

'The formal condition may already have reconciliation of all kinds, we are grateful if the complainant and the accused have reconciled. But in the formal condition, of course, we need to examine the material, one of the conditions in the material is not to cause unrest or rejection from the community because this is public law and it went viral some time ago, of course, we will see how the process goes, we also coordinate with the investigators,' he continued.

2. Still Coordinating with the Prosecutor's Office

After both conditions are fulfilled, the police will coordinate with the prosecutor's office. "If there is a settlement, of course, the peace agreement will be attached to the case file, in the current investigation process, we need to coordinate with the prosecutor's office," he said.

For now, Susatyo continued, the Leon Dozan case is still being processed by investigators, both for the alleged assault case against Rinoa Aurora Senduk under Article 351 of the Criminal Code and the defamation of the Indonesian Police Institution under Article 207 of the Criminal Code. "Yes, everything is still ongoing, everything is still going," he said.
