Spreaders of Gisella Anastasia's Indecent Video Sentenced to One Year, Legal Counsel Prepares Defense Note

Kapanlagi.com - The Public Prosecutor's Office (JPU) has demanded a one-year sentence for the spreader of Gisella Anastasia's video, namely PP and MN. This was conveyed by MN's legal representative, Andreas Nahot Silitonga, when contacted on Tuesday (8/6/2021). Andreas said that his client was charged with one year of imprisonment and a fine of 50 million for the act.

"The demand is one year with a fine of 50 million or a substitute of three months in prison. (Both apply)," said Andreas.

1. Have Prepared a Defense Note

Andreas said that he has also prepared to read the defense note. According to him, MN has not been proven to have committed the actions accused by the prosecutor.

"Have prepared the defense, essentially we feel that the prosecutor is demanding with alternative articles, he feels that the pornography aspect is not fulfilled, we agree. Because our client's actions are not spreading, only transmitting to a WhatsApp group. If it spreads, it can cause it to become viral," he said.

2. No Intention to Spread

According to Andreas, his client never intended to spread the video. According to him, MN only asked about the truth of the actors in the video.

"So he has a constitutional right protected by article 28 letter F of the Constitution, which is the right to obtain information, and in our opinion, that is also not proven," he said.

"The hope is for him to be acquitted because there is no similarity of intentions between these two people, one of them actually spread it on Twitter," Andreas concluded.
