Kapanlagi.com - Yudha Arfandi has been named a suspect in the murder of Tamara Tyasmara and Angger Dimas' son, Dante. As previously reported, Yudha is suspected of committing the murder by drowning Dante in a swimming pool.
This case apparently caught the attention of legal experts, one of whom is Dr. Chairul Huda SH MH. According to this criminal law expert, the steps taken by the police are appropriate.
"Yes, from what I have read, this issue is indeed very personal, from the suspect who has been identified by the police to the victim, let's say like that, so far the steps taken by the investigators, I think, are appropriate," said Dr. Chairul Huda SH MH in Pamulang, South Tangerang, on Wednesday (21/2/2024).
"To ensure the certainty of criminal aspects, especially what I think is the strongest is intention. Causing someone's death at least, so it's murder or negligence resulting in death," he continued.

Chairul Huda also added, from the CCTV footage and autopsy results of Dante's body, these two elements will become evidence for the police in handling the alleged murder case of Tamara's child.
"I think the strongest evidence is the CCTV footage of the incident, which shows and is connected to the victim's results. So, the examination of the body carried out on the victim will also correlate in the future," he said.

The widespread news of this tragedy has led the public to speculate that Tamara was involved in planning the murder of her child. Moreover, before Dante died, Tamara and her previous lover had already checked the swimming pool they would visit together.
"In criminal law, there is no such thing as planned murder, but what is true is premeditated murder. So, there is a long or short period of time to think about the act," said Chairul Huda.
"There are two sides, the parents of the victim and the suspect, if they want to plan something, what is the basis? Because such actions are clearly spontaneous. There is no basis stating a plan in this case. If, for example, the parents of the victim previously surveyed or visited the place that later became the crime scene, I think it's a matter of habit," he continued.

As a legal expert, the main thing to be seen and considered is the facts on the ground. From these facts, it can be determined whether Tamara is truly involved.
"When a legal person talks about facts. so the facts do not connect. Yes, I hear, see, read the facts, more or less between the perpetrator and the victim's mother, they have been in a relationship for 2 years, and they usually go out together," he explained.
"The perpetrator also has a child of the same age, let's say with the victim who is also familiar. Well, those are the facts we see, which we try to consume legally. If we consume it legally, it is difficult to associate this incident with the involvement of the mother," he added.
Another allegation, Tamara Tyasmara is accused of being negligent in taking care of her child, which led to his death. However, from a legal perspective, the CCTV footage does not show negligence on the part of the mother, but rather another intervention from the perpetrator.
"She did not let her child go to the swimming pool alone, but went with her close friend and her child, let's say like that. So, it can only be considered negligence if the child walks alone to the pool without the supervision of the mother because they cannot swim and eventually drowns," he said.
"Then the victim's death from the CCTV footage is not due to drowning or not being able to swim well enough, there is physical intervention from the perpetrator on the victim's body that causes the victim to be in a restrained condition, which eventually leads to death," Chairul concluded.
