Vina Case Attracts Attention, Amstrong Sembiring Suspects There is a Mistake?

This case has also attracted the attention of legal expert, JJ Amstrong Sembiring. He is interested in dissecting the death of Vina.

As reported from a YouTube video, JJ Amstrong Sembiring started studying the case from the beginning of Vina's murder until now, which resurfaced after its story was adapted into a film.

"What is the quality and weight of the witness's statement compared to the defendant's statement? Which one has the highest quality weight?" asked JJ Amstrong Sembiring in the YouTube video that was aired on Thursday (13/6).

"But in the understanding of criminal law philosophy, of course, the witness's statement has the highest quality weight, not the defendant's statement. That's why the defendant's statement is ranked fifth in Article 184 of the Criminal Procedure Code. So, the first is the witness's statement, the second is the expert's statement, the third is the letter, the fourth is the evidence, and the fifth is the defendant's statement," he continued.

1. Highlighting Cases

There was a commotion when the police corrected the number of people who were wanted from 3 individuals to one person after Pegi Setiawan, also known as Perong, was arrested. Amstrong Sembiring provided an explanation regarding this matter.

"Yesterday, the Head of Public Relations Division of the Indonesian National Police stated that we did not eliminate the case, instead, it was because the witness was fictional. This means that these two wanted individuals are still under investigation because the evidence is still insufficient," he said.

"If we talk about Pegi Setiawan, there is a debate about his house not being in that location, his skin being different, and the fact that his hair is not curly as mentioned by the police. That's what I said earlier, according to the legal logic within the regulations of the National Criminal Investigation Agency, it is stated in the fifth point. Debates like this are common, it's administrative. But it doesn't mean that the police are perfect, as I have explained earlier, there have been carelessness in some cases years ago," said Amstrong.

2. Is There an Error?

However, Amstrong Sembiring firmly stated that errors in determining someone as a DPO (wanted person) cannot be tolerated. He also assessed that in Vina's murder case, there has been a mistaken arrest.

"What we cannot tolerate the most is when someone who is not involved in a criminal act is put on the DPO list," he emphasized.

"Automatically, in the case of Pegi Setiawan, this is the wrong person, a mistaken arrest," concluded Amstrong Sembiring.
