Moment Lesti Kejora Asked to Sing by the Judge During the Copyright Law Material Test Hearing

There was an unusual sight during the continued hearing of the judicial review of the Copyright Law held at the Constitutional Court (MK), Central Jakarta, on Tuesday (22/7/2025). Dangdut singer Lesti Kejora, who was present as a witness, was asked to perform by one of the constitutional judges in the midst of her testimony.

The singer's presence at the MK building was to testify on behalf of the petitioners, namely Vibrasi Suara Indonesia (VISI). On this occasion, the wife of Rizky Billar provided information regarding the legal issues she had faced related to a report from the songwriter, Yoni Dores.

After outlining the case, the atmosphere in the courtroom suddenly became relaxed when Judge Suhartoyo made a unique request. The judge asked Lesti to sing a verse from one of her own songs.

"If the other songs should not be sung because they are under dispute. Just try one verse," said Judge Suhartoyo.

Without hesitation, Lesti Kejora immediately fulfilled the request. She sang one verse from her song titled 'Angin', filling the courtroom momentarily with the sound of her voice.

A similar moment also occurred with singer Sammy Simorangkir, who was present as a witness on the same day. After Lesti, Sammy was also asked by the judge to sing. Sammy then performed a snippet of his song titled 'Bila Rasaku Ini Rasamu'.

The presence of these singers is part of a struggle initiated by VISI. It is known that this constitutional review request was officially submitted on March 10, 2025, by a group of 29 singers who feel uneasy about the existing regulations.

At least, there are four crucial points that are the main focus in this material test application. VISI hopes that the Constitutional Court can provide a clear interpretation to clarify the confusion regarding the performing rights royalty system.

First, the singers question whether to perform a song, they must obtain direct permission from the song's creator. This often becomes a source of disputes in the field between singers and songwriters.

Second, VISI requests clarification regarding who has the legal obligation to pay performing rights royalties. Is this obligation attached to the singer or to the event organizer who invites them.

Furthermore, this application also questions whether individuals or legal entities can unilaterally collect and determine royalty rates. Meanwhile, there is already a National Collective Management Institution (LMKN) and Ministerial Regulation that governs the mechanism and its rates.

Lastly, an equally important point is to determine the legal status of the breach of royalty payment. The singers want certainty about whether such cases fall into the category of criminal offenses that could lead to imprisonment or are purely civil matters.
