Kapanlagi.com - ZA (18), a student who stabbed a robber to death in Malang, was finally demanded one year of rehabilitation. The Public Prosecutor (JPU) demanded that the suspect, who is still in the 3rd grade of high school, undergo rehabilitation at a Children's Welfare Institution (LKSA).

The trial took place in closed session at the District Court (PN) in Kepanjen, Malang Regency. JPU Kristiawan, in the trial with the agenda of reading the demand, considered ZA guilty and proven to have committed an act of assault that caused someone's death.

"ZA has been proven and legally guilty of committing a criminal act of assault resulting in someone's death as regulated in Article 351 of the Criminal Code," said JPU Kristiawan on Tuesday (21/1).

1. Prove the Act of Abuse

The prosecutor's office included several pieces of evidence such as a motorcycle, flip-flops, a flashlight, a 30 cm long kitchen knife, a black jacket, a black sarong, and shorts.

Meanwhile, the Coordinator of ZA's Legal Team, Bhakti Reza Hidayat, stated that the charges of Article 340 regarding Premeditated Murder and Article 338 regarding murder could not be proven by the prosecutor's office. However, the prosecutor's office still wants to prove Article 351 regarding Abuse that causes someone's death.

"But the prosecutor wants to prove Article 351 paragraph 3 related to abuse that causes death, which is then charged against ZA," Bhakti emphasized.

2. Sentenced to 1 Year

The threat of punishment under Article 351 paragraph 3 is 7 years in prison, but the prosecutor's office demands a 1-year sentence for ZA with placement in a Social Welfare Institution. The trial itself was delayed for several hours because the prosecutor's office had to prepare the indictment files.

The next agenda of the trial is the defendant's plea before the reading of the verdict. The panel of judges is scheduled to deliver the verdict on ZA on Thursday (1/23).

"Our JPU team will present a plea that these three articles must be connected to Article 49 paragraph 1 and 2 regarding the justifying elements in carrying out this activity," Bhakti stated.

3. Previously Threatened with Life Imprisonment

Previously, ZA was haunted by the threat of life imprisonment. In the previous trial, the Public Prosecutor (JPU) read out the indictment, in which ZA was charged under Article 340 of the Criminal Code, Article 338 of the Criminal Code, Article 351 of the Criminal Code (3), and Emergency Law Article 2 (1), with a threat of life imprisonment. The indictment was read by the JPU in a closed trial held at the Kepanjen District Court on Tuesday (14/1).

The trial was chaired by Judge Nunik Defiary, with the reading of the indictment conducted by JPU Kristriawan. However, the articles charged were questioned by ZA's legal counsel, who claimed that the threat of punishment was unclear..

"Why is it unclear? One example is that ZA is accused of premeditated murder. But, ZA was riding a motorcycle with his female friend when they were intercepted by robbers," said ZA's legal counsel, Bakti Riza Hidayat, to the media after the trial.
