Perpetrator of the Mutilation in Pasar Besar Malang Sentenced to Life Imprisonment, Still Shows No Remorse

Kapanlagi.com - Sugeng Santoso (49), the defendant in the murder and mutilation case in Pasar Besar Kota Malang, has been sentenced to life imprisonment. The prosecutor assessed that the defendant was proven to have planned the murder and mutilation of the victim after failing to fulfill his sexual desires.

The demand material read by the Public Prosecutor (JPU) Wanto Hariyanto, SH. stated that the perpetrator was proven to have killed the victim because he failed to fulfill his sexual desires. The defendant then killed and mutilated the victim's body before it was found by the public.

"The defendant is sentenced to life imprisonment because the prosecutor believes that the defendant has been proven to commit murder according to Article 340 of the Criminal Code," said Wahyu Hidayatullah, the Head of the Criminal Division of the Malang District Attorney's Office, on Wednesday (12/02).

1. No One Lightens

The Head of the Malang City Prosecutor's Office, Andi Darmawangsa, SH., MH. added, there is nothing that lightens the demand for Sugeng Santoso. The defendant himself does not admit his actions and is evasive in giving testimony.

"The consideration is not admitting his actions, being evasive, and showing no remorse even though he has brutally killed. In essence, there is nothing that lightens," he explained.

2. Delayed Several Times

The reading of the demand took place in a trial at the Malang District Court on Wednesday (12/2) afternoon. The trial of the demand itself was delayed several times due to the readiness of the demand materials.

Sugeng, a resident of Jodipan Gang III Street, Malang City, is suspected of being the perpetrator of the murder of a woman whose body was found on the second floor of the Pasar Besar. The victim's body was cut into five parts scattered around the location, and writings were also found on the victim's foot sole.

3. Sugeng Continues to Deny

Sugeng is charged with Article 340 of the Criminal Code and Article 338 of the Criminal Code for alleged murder and mutilation. However, Sugeng always claims that he did not kill the victim, but the victim died due to illness, although he admits to mutilating the victim. Sugeng confessed that the victim was already dead when his body was cut.

Iwan Kuswardi SH MH, Sugeng Santoso's legal advisor, told reporters that based on the facts presented in court, none of the evidence submitted by the Prosecutor could prove that the defendant planned the murder. The indictment does not mention how Sugeng killed the victim using a cutter.

"The indictment states that Sugeng killed the victim by suffocating and cutting the neck using scissors," said Iwan.

4. Should Be Equivalent

Iwan disagrees and questions the Prosecutor's belief that the defendant planned the murder to the extent of being sentenced to life imprisonment. The demand is considered baseless, as the facts presented in court do not show the defendant as the perpetrator of the alleged murder.

"The demand for life imprisonment should be equivalent to the act committed," he emphasized.

Iwan, along with a team from LBH Peradi Malang Raya as Sugeng's advocate, claimed to have other trial facts that refute the demand. Among these facts is the result of the autopsy, which states that no signs of violence were found on the victim's body and limbs after death.

The next hearing will be held on Monday (17/2) with the defense agenda from the legal counsel.
