Agnez Mo Sued by Ari Bias, First Hearing Directly for Reading the Lawsuit

Kapanlagi.com - Songwriter Ari Bias has filed a lawsuit against Agnez Mo at the Central Jakarta District Court regarding alleged copyright infringement with case number 92/Pdt.Sus-HKI/Cipta/2024/PN Niaga Jkt.Pst.

Ari Bias's legal team, Mario Pencawan, confirmed the lawsuit. According to him, the lawsuit was submitted two days earlier and only today received its official case number.

"Yes, that's correct. So we submitted it two days ago, and today we just got the case number," said Mario Pencawan when contacted by reporters on Thursday (12/9/2024).

The first hearing of this case will take place on September 19, 2024. In this initial hearing, the agenda will be the reading of the lawsuit. Mario emphasized that this case focuses on the alleged violation of intellectual property rights, particularly regarding copyright.

"In this first hearing, it will be directly the reading of the lawsuit. The material is more or less the same, because Agnes Monica used the song without permission commercially, the song 'Bilang Saja'," he said.

1. Commercial Court

The lawsuit at the Central Jakarta District Court, according to Mario, is more specifically directed at the commercial court because it concerns copyright infringement, unlike a regular civil lawsuit. Mario also confirmed that the material of the lawsuit at this District Court is more or less the same as the report that has been submitted to the Indonesian National Police's Criminal Investigation Department.

"More or less the same. But at this Central District Court, it is more towards the commercial court, because it concerns intellectual property, copyright. So the judicial system is different from regular civil cases," he said.

2. Witness in the Summoning Process

Meanwhile, the legal process ongoing at the Criminal Investigation Department is still in progress. As of now, there are two witnesses who have not yet been summoned by the investigators. One of them is KCI (Indonesian Copyright), which has been summoned but has not yet provided a statement.

"It is still ongoing, there are 2 witnesses who have not been summoned yet. But yesterday we just communicated with the investigators, we are not limited to these two," he said.

Additionally, PT Aneka Bintang Gading, a company also related to this case, is an important witness still in the summoning process.

"So one of them is KCI, (has been) summoned but has not come. The last one is directly from PT Aneka Bintang, PT Aneka Bintang Gading," he said.

When asked about the continuation of the case at the Criminal Investigation Department, Mario confirmed that both legal processes, at the Criminal Investigation Department and at the District Court, are proceeding simultaneously. So far, there has been no directive from the Criminal Investigation Department to stop the investigation or to delay the ongoing legal process.

"So far it is still ongoing. There has been no communication from the investigators or the Criminal Investigation Department to stop. Both are proceeding," concluded Mario Pencawan.
