Appeal Rejected, Gaga Muhammad Files Cassation to Supreme Court

Kapanlagi.com - Gaung Sabda Muhammad's lawyer, Fahmi Bachmid filed a cassation to the Supreme Court through the East Jakarta District Court on Tuesday (17/52/2022). This was done because the appeal filed by Gaga Muhammad was rejected by the High Court Judges of DKI Jakarta.

"Today, Kang Asep (Gaga Muhammad's father) asked me to file a cassation statement, in accordance with the Criminal Code that grants someone the right to file a legal action. It is given to all defendants, they have the right to appeal, if they disagree, they can file a cassation," said Fahmi Bachmid at the South Jakarta District Court on Tuesday (17/5/2022).

1. Immediately Provide Cassation Memorandum

Fahmi Bachmid stated that they will provide the cassation memorandum as soon as possible within the specified time, and no later than two weeks from now.

"I was given time by the law under the Criminal Code to submit the cassation memorandum, the cassation memorandum is due in 14 days, but I will submit it within the next 7 days, insyaallah I will submit it next Sunday," he said.

2. Gaga's Last Effort

Fahmi stated that this is Gaga Muhammad's final step in seeking justice. Moreover, this cassation request has been based on the approval of Gaga Muhammad's family, namely his father Asep Yusman.

"This will seek justice through the highest court in the Supreme Court, Gaga's father, including Gaga, has entrusted me fully and today. I have declared his cassation like that. Next week, I will submit his cassation memorandum," said Fahmi.

"After the cassation memorandum, the prosecutor will respond with a counter, then the file will be sent to the Supreme Court after that, which will decide, because the peak of the judicial process is in the Supreme Court. Those seeking justice can use their rights according to the Criminal Code to file an appeal and cassation," concluded Fahmi.

3. Sentenced to 4.5 Years

As previously reported, the East Jakarta District Court sentenced Gaga Muhammad to 4.5 years in prison and a fine of Rp 10 million. This is because Gaga Muhammad was found guilty and negligent in driving.

However, Gaga Muhammad's party immediately filed an appeal with a 44-page memorandum. Not only that, Gaga Muhammad's mother also included proof of money transfer to Laura Anna's family. It is known that this case began with Laura Anna's report of the accident she experienced with Gaga Muhammad on December 8, 2019.
