Both of them are the judge's considerations in rejecting the arguments based on those unsworn witnesses. However, there are several considerations that we agree on, firstly, the fact that our client is the creator and copyright holder," he said in a phone interview on Monday (30/3).
"The second discovered data and acknowledged as a fact without prior permission has changed the lyrics, without prior permission has produced fixation, without prior permission has communicated the creation. That fact is called, that's the main point," he added.
He also talked about the song cover that was disputed by Nagaswara. He said that the song cover is not about trends, but about the law.
"What we disagree on is whether covering songs violates the law? Earlier, it was mentioned based on the testimony of witnesses Atta, Thariq, and Jejen, stating that covering songs has become a trend, but the issue here is the law, not the trend. Legal issues should be based on the law, not the trend. This means that the problem we have is simply why not just ask for permission," he said.
"Apparently, it is seen that it is considered a trend, and the ethics of the trend is permission, which is already regulated by law. Maybe you can check Article 9 paragraph 2, whoever exercises economic rights must obtain permission from the creator and copyright holder. Our objection is that there are witnesses whose testimony is not sworn but their statements are taken into consideration and declared under oath. We clearly object," he concluded.
