The case of alleged dissemination of video evidence or personal content in the polemic of Inara Rusli and Insanul Fahmi has caught the attention of Hotman Paris. This flamboyant lawyer compares the situation to the case of immoral video that once befell Ariel NOAH a few years ago.

Hotman reminds that elements of negligence or intent in storing and disseminating personal data could lead to criminal charges. Even if the data owner does not directly disseminate it to the public, if the data leaks due to negligence, the law can still apply.

"For example, take the case of Ariel, he did not distribute it, he was negligent in storing it on his laptop and it was taken by his nephew, that is a problem. Now, that is an example where just not distributing it leads to consequences, let alone if it is sent to several people," explained Hotman when met in Rawamangun, East Jakarta.

Hotman's analysis is related to the video evidence that is reported to be held by the complainant in the Inara Rusli case. Hotman emphasized that the judge will consider the impact of the spread of that content.

"The judge will look at the substance, not just the six people involved. If it is indeed considered that the intent was to distribute it, then that is a problem. The judge will look at the impact of that action, whether it has spread or how it can be accessed by everyone," he explained.

In this context, Hotman assesses that the alleged legal violations are more inclined towards the distribution of content. Although the recordings may originate from personal documentation or CCTV, the act of sharing it with others could backfire.

"I think it leans more towards distribution. Because CCTV is not specifically recorded; it was already there, you know," said Hotman providing his analysis.

Regarding legal sanctions, Hotman mentioned the criminal threat for those who disseminate content that contains indecency or defamation through electronic media.

"The time to spread is subject to Article 27 paragraph 1 of the ITE Law," asserted the 66-year-old lawyer.
