Kapanlagi.com - The panel of judges at the West Jakarta District Court has read the verdict for the defendant in the drug abuse case, Lucinta Luna, in a trial held on Wednesday (30/9/2020). After considering, Judge Eko Aryanto, who chaired the panel, found Lucinta Luna guilty and sentenced her to 1 year 6 months in prison and a fine of IDR 10 million, with an alternative of 1 month in jail if the fine is not paid.
"Judging, firstly, the defendant Ayluna Putri alias Lucinta Luna is proven guilty of using narcotics. Secondly, imposing a sentence of 1 year 6 months in prison and a fine of IDR 10 million, or alternatively, 1 month in jail if the fine is not paid," said Eko Aryanto, followed by the sound of the gavel.
The sentence is lower than the demand of the Public Prosecutor who demanded that Lucinta Luna be sentenced to 3 years in prison and a fine of IDR 25 million, subsidiary to six months of imprisonment.
"The defendant's young age and lack of previous involvement in legal issues are mitigating factors," said Eko Aryanto.
As it is known, Lucinta Luna was arrested in her apartment and designated as a suspect of drug abuse by the Narcotics Unit of West Jakarta Metropolitan Police on February 11. From the arrest, the police confiscated 2 ecstasy pills and 7 riklona pills as evidence.
Lucinta Luna is charged with violating Article 127 paragraph 1 of Law Number 35 of 2009 concerning Narcotics regarding the possession of ecstasy found in her apartment. In addition, regarding the possession and abuse of psychotropic pills riklona, Lucinta Luna is charged with Article 60 and 62 of Law Number 5 of 1997 concerning Psychotropics.
During the trial, Lucinta Luna admitted to the possession of riklona, but she insisted on not admitting to the possession of ecstasy found by the police in the trash can in her residence. However, in the police report, Lucinta Luna admitted that the ecstasy belonged to her.
