Fahmi explained that according to the applicable ITE Law, only law enforcement officials have the authority to conduct wiretapping or interception, and that must be based on an official request.

"Only those who are allowed to conduct interception, those who are allowed to conduct wiretapping, are in the context of law enforcement at the request of the police and/or the prosecutor's office," emphasized Fahmi Bachmid on Antasari Street, South Jakarta, Wednesday (6/8/2025).

"Anyone who does so without a request from the police and the prosecutor's office is presumed to be committing a criminal act," he continued.

Fahmi then detailed the criminal penalties outlined in the ITE Law, specifically Articles 31 and 47, for those involved in illegal recording. The penalties are serious, reaching up to 10 years in prison.

"Anyone who intentionally without rights or against the law conducts interception or wiretapping, shall be punished with imprisonment for a maximum of 10 years and/or a fine of up to 800 million," he explained, quoting the article.

"This is an allegation of a criminal act that violates Article 31 junto Article 32 with a threat of 10 years and 8 years," he added.
