The Land is Seized, Atalarik Syach's Photo Once Offered a Car Worth 200 Million but Was Rejected

The execution of Atalarik Syach's house in Cibinong continued on Friday (15/5/2025). This time, the agenda was the seizure and destruction of part of the building assets standing on the land owned by the plaintiff, Dede Tasno.

Dede Tasno's legal counsel, Eka Bagus Setyawan, explained that this process was carried out because there was no previous complete agreement. He stated that the building standing on his client's land must cease its function and be demolished because it is illegal.

"Today, the agenda is the continuation of asset seizure, destruction, because the building is standing on our land," said Eka when met at the location.

In the latest negotiation process, Eka revealed an offer from Atalarik Syach. The offer was in the form of a car guarantee with the vehicle ownership document (BPKB), but it was rejected by the plaintiff."In the negotiation, he did offer the car's BPKB as I mentioned, which was said to be worth up to Rp200 million, but I didn't accept that so I just asked for cash," he said.

Eka stated that Atalarik finally agreed to provide cash as an initial payment. The money has been partially received and will be continued in stages."But Atalarik's commitment is that he can give today, I mentioned around 11 am we would wait for the transfer, and just now it has come in but only Rp200 million," he said.

From the preliminary agreement, Atalarik Syach agreed to an initial payment of Rp300 million. The remaining amount will be paid in installments over the next few months."So his commitment is to pay Rp300 million first, then he will have installments for several months," Eka explained.

Eka stated that his side is giving a period of up to three months for the settlement of the remaining payment. He emphasized that this process remains under legal supervision."3 months," he answered briefly when asked about the deadline.

The total compensation value imposed on Atalarik is estimated to reach Rp850 million. This figure consists of the value of the building that stands on his client's land."So, the figure of Rp850 million is based on Rp550 million for the building that stands on our land, now Rp550 million is the price per meter? Rp1.5 million. Rp1.5 million just needs to be multiplied. Thus, the figure of Rp850 million was born," explained Eka.

The remainder of the total has not yet been paid and is currently being awaited by the legal team. Eka said that his side will continue to monitor this process until it is completed."We are waiting for today as well," he said.

For the technical payment of the remaining Rp500 million in installments, Eka has handed over the arrangements to the internal team. He admitted that he prioritizes a comprehensive resolution over installment technicalities."For the technical aspects, this is being arranged by our friends internally, what’s important is that it can be resolved. But what I regret is why you had to wait for me to get to this point before you wanted to resolve it," he said.

According to Eka, this dispute could have been resolved much earlier if Atalarik had been willing to communicate openly. He believes that Atalarik should have accepted the legal reality from the beginning."Why didn’t you communicate this earlier so that this wouldn’t happen? Just admit it, don’t wait until it gets to this point, after all, you’re losing anyway," he said.

The acknowledgment referred to by Eka is about the land ownership status based on the court's decision. Since the building stands on his client's land, negotiations became inevitable."Yes, that the land is not valid based on the court's decision and there is a building that stands on our land. Thus, this negotiation took place," he emphasized.

Eka also conveyed that the land has been owned by his client's company since 1980. The lengthy legal process did not deter his client's intention to seek justice."He also stands on our land, you know. Thus, this negotiation took place, you see. This land has been owned by the company since '80," he said.

During the legal process, Eka stated that Atalarik never showed good faith to resolve the matter peacefully. Even during mediation at the sub-district, there was no significant response."The Atalarik party closed off. We did mediation with Atalarik at the sub-district several times, but nothing came of it," he said.

He also lamented that the efforts for a peaceful resolution, which should have been facilitated through the principles of restorative justice, never occurred. Thus, execution became the last option."And during this process, there is something in the law called restorative justice. Efforts for peace. That also didn’t happen," he emphasized.

Nevertheless, Eka continues to emphasize the importance of humanity in the enforcement of the law. He stated that they would restrain themselves as much as possible before ultimately resorting to execution."However, we must also recognize that the aspect of humanity should be prioritized. Although the execution is our last resort, it is not feasible for us to do that," he concluded.
