The Twists and Turns of the Gisel-Nobu Sex Video Distributors, Sentenced to 9 Months in Prison

Kapanlagi.com - The Gisella Anastasia (Gisel) and Michael Yukinobu Defretes (Nobu) sex video case caused a stir in society at the end of last year. The case began with the emergence of a 19-second sex video, which was allegedly performed by Gisel.

The video was recorded around 2017 in one of the hotels in Medan. Gisel is said to have admitted to sending the video to Nobu. Gisel was also questioned by the police. After being questioned twice as a witness, on Tuesday (29/12/2020), the police declared Gisel as a suspect in the sex video.

The police, who continue to investigate the case, then identified two individuals with the initials PP and MN, who were later arrested and declared suspects. These two individuals are known to be the massive distributors of the video.

In addition to Gisel, the police also declared Nobu as the male performer in the video as a suspect, as it is alleged that there was negligence that led to the widespread dissemination of the sex video to the public. Both of them admitted to being performers in the sex video to the police. Gisel and Nobu were required to report regularly. Until now, it is strongly suspected that the case file is still with the police.

1. Sentenced to 1 Year

Both defendants PP and MN were sentenced to 1 year in prison. The prosecutor accused the defendants of spreading a video that violated decency.

"Stating that the defendant Priyo Pambudi has been proven legally and convincingly guilty of intentionally and without authority, distributing and/or transmitting and/or making electronically accessible information and/or electronic documents that contain indecent content," the public prosecutor said as quoted from the South Jakarta District Court's Case Search Information System (SIPP), Tuesday (8/6).

There are two defendants in this case, Muhammad Nurfajar and Priyo Pambudi. The public prosecutor has demanded a 1-year prison sentence and a fine of IDR 50 million, with a subsidiary sentence of 3 months in prison.

"Imposing a sentence on the defendants Priyo Pambudi and Muhammad Nurfajar with a 1-year prison sentence reduced during the defendants' detention, with an order for the defendants to remain in custody and pay a fine of IDR 50,000,000. If not paid, it will be replaced with a substitute sentence of 3 months imprisonment," as reported by SIPP PN Jaksel.

2. Considered Disturbing

The two defendants who spread the explicit video are sentenced to 1 year imprisonment. The prosecutor considers the defendants' actions disturbing to society. However, there are mitigating factors, namely their responsibility to their families.

"What makes it burdensome is that (the defendants' actions) disturb society," said South Jakarta State Prosecutor's Office Intel Section Head Sri Odit Megonondo when asked for clarification on Tuesday (8/6/2021).

As for the mitigating factors, the defendants are the backbone of their families.

3. Sentenced to 9 Months

The South Jakarta District Court finally sentenced PP and MN, the spreaders of the explicit video of Gisella Anastasia-Michael Yukinobu Defretes, to 9 months in prison. They were found guilty of spreading pornographic videos.

"The sentence is 9 months in prison and a fine of IDR 50 million, with a substitute sentence of 3 months if the fine is not paid," said PP's lawyer, Robert Sihotang, today on Tuesday, 13/7 via detikcom.

The sentencing hearing was held at the South Jakarta District Court this afternoon. In the trial, they were proven legally and convincingly to have violated Article 45 paragraph (1) in conjunction with Article 27 paragraph (1) of the ITE Law.

"Yesterday, the prosecutor charged them with the ITE Law and pornography, but in the trial, the pornography was not proven, it was only considered spreading," he said.

4. Thinking of Filing an Appeal

In response to the verdict, the lawyer expressed his objection. According to him, his client was not the first person to spread the explicit video of Gisel and Nobu.

"We object to the verdict, because he was not the first one," he said.

However, Robert stated that they are still considering. Robert will consult with his client whether to file an appeal or not.

"If the prosecutor accepts the verdict, we are still considering," he said (via detikcom).
