Tiktok Celebrity Vicky Kalea Investigated After Misusing Indosiar Logo in Parody 'Jasa Bikin Anak Keliling'

Kapanlagi.com - TikTok influencer @vicky_kalea has been reported to the police after using the logo of PT Indosiar Visual Mandiri in his parody content titled 'Jasa Bikin Anak Keliling' (Service of Making Wandering Children). Initially, Indosiar became aware that Vicky had created content by using the Indosiar logo on July 4, 2023. The TikTok influencer admitted to creating the content using his own mobile phone. Vicky's wife often assisted him during the content creation process. The parody content has benefited Vicky by increasing his number of followers.

"The @vicky_kalea account, which features video content parodying the 'Pintu Berkah' program with the title 'Jasa bikin anak keliling' (Service of Making Wandering Children), uses or includes the Indosiar television logo without the permission and knowledge of PT Indosiar Visual Mandiri," said West Jakarta Metro Police Chief, Commissioner Syahduddi, on Thursday (11/16/2023).

"Investigators found that Vicky Kalea's TikTok account has been viewed 19 million times on TikTok, with a total playback time of 25,246 hours. As a result of this content, Vicky Kalea's TikTok account has gained an additional 55 thousand followers," explained Syahduddi.

When questioned by the police, both the suspected perpetrator and the reporter agreed to pursue a peaceful resolution. Both parties were mediated by the police. Due to his actions, Vicky could potentially violate Law Number 20 of 2016 concerning Trademarks and Law Number 19 of 2016 concerning Amendments to Law Number 11 of 2008 concerning Electronic Information and Transactions, with a punishment of 5 years imprisonment and a fine of Rp 2 billion.

"With the request for mediation by the accused to the West Jakarta Metro Police, the parties will be mediated to achieve restorative justice," said the West Jakarta Metro Police Chief.

1. Damaging Indosiar's Reputation

The national TV station Indosiar's soap opera program, Pintu Berkah, has become a parody platform for a number of content creators. This is because the content is made in a peculiar way. This has tarnished the image of PT Indosiar Visual Mandiri. The Vice President Legal of PT Indosiar Visual Mandiri stated that Vicky's behavior has caused them losses. Even Indosiar's reputation has declined.

"First, he used the Indosiar logo brand, which we have explained is protected by law. And we have the rights to the intellectual property in the form of that brand," said Sunarsih on Thursday (16/11/2023).

Not stopping there, Sunarsih highlighted the vulgar narrative in the title that he parodied. Even though the aired soap opera titled 'Pintu Berkah' gives a religious impression.

"(Vicky) uploaded it, used the Indosiar brand, and even parodied the program with a narrative that is very inappropriate for Indonesian society," said Sunarsih.

2. Hoped Not to be Repeated

Sunarsih admitted to receiving many complaints from the public regarding viral videos that have spread widely in the community. In the future, they will not hesitate to take legal action if they find similar cases to Vicky's.

"There are so many questions from authorized parties questioning the image of Indosiar, which has a program that appears to be part of Indosiar's program, and this greatly concerns us," said Sunarsih.

"We hope that this incident will be a good lesson for Vicky Kalea, as well as for the wider community, especially for content creators, in using logos and using programs without permission, which should face legal consequences. Because there is protection for intellectual property rights," said Sunarsih.

3. Vicky Kalea Apologizes

At the same time, Vicky admitted to his actions and apologized for tarnishing the reputation of Indosiar and creating a bad image.

"In the video, I used the caption of the show and the logo of the Indosiar TV station to parody the program 'Pintu Berkah' without asking for permission beforehand. And my actions have caused harm to Indosiar, so I deeply regret it," said Vicky.

He also reminded content creators not to casually parody and use it as entertainment on social media. There are boundaries that must be recognized, such as narration and norms.

"Once again, I urge social media users, especially content creators or anyone, to learn about the laws and restrictions that are prohibited or harmful to others. Do not parody the creative works of others, especially with inappropriate narratives that violate ethics and contradict Indonesian cultural norms," he concluded.
