"When we were in the initial case back in September, we eventually withdrew the lawsuit because the summons was deemed inappropriate. At that time, the case number was 3010/2024," Wijayono stated after a recent hearing.

According to him, in the previous case, Ferry's address could not be found, so the legal procedures according to HIR could not continue. "We held hearings almost three times, but the address was not found. Ultimately, we withdrew because legally it was indeed not possible to proceed," he continued.

This time, Venna Melinda's legal team is taking various measures to ensure that the court summons is considered valid. They even have to face the challenge of the personal data protection law, namely Law No. 27 of 2022, which strictly regulates access to an individual's information.

"We cannot arbitrarily request address data from unauthorized parties. So we hunted in various places. Until we finally found the exact address with great difficulty," Wijayono explained.

The process of finding the address involved visiting locations and communicating with the local neighborhood and village officials. They ensured that all information was accurate and valid.

"We even requested a letter of confirmation that he indeed resides there. Only after being confident did we proceed with the lawsuit," he said.

When asked if they had a chance to meet Ferry or his family members at the location, Wijayono said no. "No, no. We only went through the neighborhood officials, and they conveyed that Ferry indeed lives there," he revealed.

3. The Divorce Process Can Only Proceed Again

The certainty of this residence location is an important step in Venna Melinda's legal process. With the verified address, this court summons is considered valid, allowing the divorce process to resume in court.

Wijayono also emphasized that this effort is made to ensure the lawsuit proceeds according to legal procedures. "We want everything to be done correctly and legally orderly. Therefore, we really ensure everything first before returning to court," he said.
