A total of 29 singers who are members of the Indonesian Sound Vibration (VISI) officially filed a request for a judicial review of Law No. 28 of 2014 on Copyright (UUHC) to the Constitutional Court (MK). The request has been registered under Number 38/PUU-XXIII/2025.

The legal representative of the 29 musicians, Panji Prasetyo, believes that this step is the best way to resolve the debate regarding the permission to perform songs and the performing rights royalties that have been contentious.

"In my opinion, the most correct path is to go to the Constitutional Court. Because the public space has become chaotic, unfocused, filled with agitation, and a lot of misinformation. We shouldn't go crazy, this law is being attempted to be disturbed, ruined by people with interests," said Panji when met at his office in Cilandak, South Jakarta, Friday (14/3/2025)."Yes, we are trying the constitutional route, we are going to the Constitutional Court, we are asking questions related to performing rights," he added.

In their petition, the 29 singers requested the Constitutional Court to review five articles in the Copyright Law, namely Article 9 paragraph (3), Article 23 paragraph (5), Article 81, Article 87 paragraph (1), and Article 113 paragraph (2).

"Our suggestion is so that there is no more confusion. In legal terms, four out of five articles are still declared constitutional, but with extended explanation, meaning with additional explanations. Why? So that people are not confused," said Panji.

According to Panji, the regulations in the Copyright Law are actually principled. However, some parts are considered to still give rise to various interpretations that lead to differing opinions in society.

"So, this Law is correct in principle, but the problem may be the systematics or the wordings (choice of words), so that people can interpret it in various ways. Therefore, if that is regulated more accurately with more precise language, there may not be any more problems, perhaps there won't be any wild interpretations anymore," he explained.

Panji also emphasized that this legal step is a more elegant form of resolution than continuing to debate in public spaces. Furthermore, he ensured that the VISI singers will accept and follow whatever decision is eventually established by the Constitutional Court.

"We are just asking for certainty here. Later, if the Constitutional Court, for example, does not align with our (material test request) – even though it seems unlikely if we look at the current Constitutional Court judges – they will commit, they will follow through. Later, if the Constitutional Court judges decide that this indeed requires direct permission, we will comply with it," he concluded.
