Failed Mediation, Ustaz Yusuf Mansur Refuses to Pay Compassion Money for 2 Migrant Workers

Kapanlagi.com - The Tangerang District Court held a hearing on a case of illegal conduct with defendant Ustaz Yusuf Mansur, on Tuesday (26/1/2022).

In the scheduled mediation hearing, the plaintiffs, two female migrant workers named Sri Sukarsi and Marsiti, were unable to attend. Ustaz Yusuf Mansur was also absent.

Nevertheless, the hearing proceeded with their respective legal representatives.

"Today's agenda is mediation. Our clients, Mrs. Sukarsi and Mrs. Marsiti, couldn't attend. The defendant also couldn't attend. So we agreed to proceed with the mediation without the presence of the principal," said Asfa Davy Bya, the plaintiffs' legal representative.

1. Mediation Failed

Mediation, according to Asfa, ended in failure. This is because Utaz Yusuf Mansur, as the defendant, refused to pay the requested compensation. As a result, no agreement was reached between the plaintiff and the defendant.

"When the mediation was opened, the Judge asked us if we still stood by our claim, and our response remained the same. However, the defendant's legal representative stated that they could not accept the claim," said Asfa Davy Bya.

2. Requesting Evidence

Ustaz Yusuf Mansur's reason for not fulfilling the claim is because he requested evidence. However, the plaintiff objected. According to Asfa Davy, the evidence should be presented in the main trial.

"When asked why they rejected it, the mediator Judge asked for evidence. If the evidence is not discussed in the mediation session but in the main trial, then we agreed that the mediation failed and will proceed to the main trial. The schedule for the next hearing has not been determined yet," said Asfa.

3. Ready to Fight

Asfa said that they are ready to fight in the main trial with various evidence that has been prepared.

"Of course, as the plaintiff, we already have the evidence. There is evidence of transfers, evidence of refunds, and evidence of Ustaz's photos there," he said.

4. Land Investment

For your information, the case started when Ustaz, who is familiarly called UYM, gave a lecture in Hong Kong. UYM, besides giving lectures, also invited the congregation to invest in land funds.

Sri Sukarsi and Marsiti, who were part of the congregation, were interested in UYM's offer.

After investing their money, Sri Sukarsi and Marsiti, who did not see clarity in the investment program, asked for their money back, and UYM returned it in 2019. However, without any charitable funds or profit-sharing as promised.

5. Request for Compassion Money

As a result, both domestic workers demanded their rights by filing a civil lawsuit at the Tangerang District Court. In the lawsuit, they requested compassion money of 8 percent per month from the profits, which, if totaled, each should have received Rp 190 million and Rp 140 million.

"The compassion money is calculated from the time they deposited the money until they filed the lawsuit. If accumulated, we calculated one to be Rp 190 million and the other to be 140 million. Because they invested the money at different times," said Asfa.
