Kapanlagi.com - The feud between Posan Tobing and his old band, Kotak, is not over yet. After his lawsuit regarding the rights to the band name was rejected by the Yogyakarta High Court, the former drummer did not remain silent.
Through his attorney, Minola Sebayang, Posan assures that he will continue his fight by filing a cassation to the Supreme Court (MA). This effort is made to defend his rights to the band name that he co-founded from the beginning.
"We will file a cassation. Our calculation is that the deadline is until May 28. After that, we will announce the cassation memorandum," said Minola when met at his office in the Kuningan area, South Jakarta, Wednesday (21/5/2025).
This cassation step is a continuation of the lawsuit previously filed in the Sleman District Court in November 2024 with case number 265/Pdt.G/2024/PN Smn. The lawsuit was also registered by two other former members, Pare and Icez.
The issue began with the registration of the band name Kotak with the Directorate General of Intellectual Property (HAKI), which Posan claims was done without involving him and the other two founders.
"Hopefully, the judges at the Supreme Court can see the evidence and hear testimonies about the history of the establishment of the name KotaK. Only then can it be decided whether there is a breach of contract or not. That would be fairer," said Minola.
In his lawsuit, Posan emphasizes that the name Kotak was born from a collaborative process between him, Pare, Icez, and Cella, long before the band's formation changed as it is now.
"At that time, Tantri and Chua had not yet joined, and they didn't even know us when this band was formed. But suddenly the name KotaK was registered with HAKI. That made us disappointed," said Posan.
Now, with the deadline for filing a cassation approaching, Posan's side hopes that the Supreme Court can provide a more comprehensive consideration of the history of the band that once thrived in its time.
