What Makes Gaga Muhammad's Demands Lighter Than Accusations, Being Polite and Still Young

Kapanlagi.com - Instagram celebrity Gaga Muhammad is sentenced to 4 years and 6 months in prison for a traffic accident that paralyzed his ex-girlfriend, Laura Anna.

The demand was read by the Public Prosecutor in a trial held at the East Jakarta District Court on Tuesday (4/1/2022).

The demand of the Public Prosecutor's Office against Gaga Muhammad is lighter than the previous accusation. It is known that Gaga Muhammad's actions are charged under Article 310 paragraph 3 of Law Number 22 of 2009 concerning traffic and road transportation with a maximum punishment of 5 years in prison.

1. Make Laura Paralyzed

In his indictment, the prosecutor also read out several aggravating factors against Gaga Muhammad in the traffic accident case. One of the aggravating factors against Gaga Muhammad in this case is causing Laura Anna to experience paralysis.

"The actions of the defendant that resulted in paralysis for the victim Laura Anna Edelenyi had an impact on the loss of productivity of the victim Laura Anna Edelenyi as a celebrity. The defendant's actions caused psychological and trauma effects on the victim Laura Anna Edelenyi, and it cannot be determined whether Laura Anna Edelenyi's severe injuries or paralysis will heal," said the prosecutor during the trial on Tuesday (4/1/2022).

"The defendant was driving under the influence of alcohol and there was no reconciliation between the defendant and the victim Laura Anna Edelenyi, as well as no financial assistance for the treatment and medical expenses from the defendant to the victim Laura Anna Edelenyi," added the prosecutor.

2. Lighten Gaga's Punishment

Furthermore, in addition to reading several points that aggravate Gaga Muhammad's punishment, the prosecutor also read things that lighten the 21-year-old man's sentence.

"Things that mitigate the defendant's actions, being polite during the trial, the defendant is aware of his mistakes and regrets his actions, the defendant has never been punished for a crime. The defendant is still young and is expected to improve his behavior in the future," said the prosecutor.

3. The Prosecutor's Obligation

In his demand, the prosecutor demanded a 4-year and 6-month prison sentence for Gaga Muhammad. After the trial, Gaga Muhammad's lawyer, Fahmi Bachmid, stated that the demand has become the prosecutor's obligation to provide a demand for his client. His party will submit a defense plea in the next hearing, which will be held on Monday (10/1/2022).

"The prosecutor's demand is 4 years and 6 months, and it is the prosecutor's right to submit a demand later on. I will submit a defense plea," said Fahmi Bachmid at the East Jakarta District Court on Tuesday (4/1/2022).

"From the defense plea, ultimately the panel of judges will decide how the panel of judges will decide this case and how severe the punishment for Gaga will be, which will be seen in the next process," Fahmi continued.

4. Hand Over Matters to Legal Counsel

Fahmi Bachmid stated that Gaga Muhammad did not respond to the prosecutor's demands. Gaga Muhammad handed over all his matters to his legal team.

"Gaga didn't speak earlier, he just handed it over to me to submit a defense statement. Well, I will prepare this defense statement and maybe Gaga will prepare it too, we'll see how it goes," he said.

5. Demands from the Prosecutor

The trial of the traffic accident case involving Gaung Sabda Alam Muhammad alias Gaga Muhammad was held again at the East Jakarta District Court on Tuesday (4/1/2022). This time, the agenda of the trial was to listen to the demands from the Prosecutor.

In this trial, Gaga's father and mother were present in the court. Likewise, Gaga's sister Laura Anna and Greta Irene were also present in the trial. Several celebrity friends, including Keanu Agl and Erika Carlina, were also seen attending the trial.

6. Proven Guilty

Based on the facts presented in the trial, the Public Prosecutor's Office (JPU) considers that Gaga has been proven guilty and violated article 310 paragraph 3 of the law on traffic and road transportation.

7. Imprisoned for 4 Years 6 Months

Then, the Public Prosecutor's Office (JPU) read out the demand against Gaga Muhammad. In the demand, the prosecutor demands a criminal sentence of 4 years 6 months in prison.

"Imposing a prison sentence of 4 years 6 months and a fine of ten million, which if not paid will be replaced with a 2-month prison sentence," he said.
