Sentenced to 4.5 Years in Prison, Gaga Muhammad Submits Defense Note

Kapanlagi.com - The Public Prosecutor (JPU) has demanded a sentence of 4 years and 6 months for celebrity influencer Gaga Muhammad in a traffic accident case that caused the late Laura Anna to become paralyzed. The demand was read out in a trial held at the East Jakarta District Court on Tuesday (4/1/2022).

After the trial, Gaga Muhammad's lawyer, Fahmi Bachmid, stated that the demand is the Prosecutor's obligation towards his client.

His party will submit a defense plea or plea of defense in the next trial, which will be held on Monday (10/1/2022).

"The Prosecutor's demand is 4 years and 6 months, and it is the Prosecutor's right to submit a demand later on. I will submit a defense plea," said Fahmi Bachmid at the East Jakarta District Court on Tuesday (4/1/2022).

1. Submit to the Judges

Fahmi then continued that the judges will ultimately determine the severity of the punishment for his client.

"From the defense statement, in the end, it will be the judges who decide how the judges will rule on this case and how severe the punishment will be or how many years of probation it will be, depending on the further process," Fahmi added.

2. Gaga Has Not Responded

Fahmi Bachmid stated that Gaga Muhammad did not give any response regarding the prosecutor's demands. The former partner of Awkarin handed over all his affairs to his legal team.

"Gaga hasn't spoken yet, he just handed it over to me to submit a defense statement. Well, I will arrange this defense statement and maybe Gaga will arrange it too, we'll see how it goes," he said.

3. Prosecutor's Lighter Demands

The demands of the prosecutor are lighter than the charges against Gaga Muhammad, who is charged with Article 310 paragraph 3, Law number 22 of 2009 concerning traffic and road transportation with a maximum punishment of 5 years in prison.

"If the threat is 5 years, then if the demand is 4.5 years, it means it is not up to 5 years. It depends on the prosecutor, my defense, and also the judge, whether the judge will decide according to the prosecutor or lighten it," Fahmi concluded.

4. Regret of Gaga Muhammad

In the previous trial, Gaga Muhammad also expressed regret to the panel of judges.

"I deeply regret this incident that caused someone (Laura Anna) to be injured," he said.

Meanwhile, after the trial, Fahmi also confirmed what his client said.

"Gaga Muhammad has been examined, has conveyed everything and he also expressed regret for the incident and he also apologized. Indeed, he was wrong, he was negligent because when he was tired, he still insisted on driving the car," said Fahmi.

"So he was momentarily unconscious or in other words, he was momentarily sleepy. So when he opened his eyes, there was a car in front of him, he was surprised and instead of stepping on the brake, he stepped on it and that's how the car flipped," Fahmi concluded.
