Public Prosecutor Rejects the Submission of Exception from Lucinta Luna's Legal Advisor

Kapanlagi.com - Lucinta Luna in the trial held on June 3, 2020, has submitted an exception regarding the drug case that involves her. Today, Wednesday (10/6), the continuation of the trial was held at the West Jakarta District Court with the agenda of the Public Prosecutor's response to the exception submitted by Lucinta Luna's legal team.

The trial ended with the rejection of the exception submitted by the legal team of the transgender artist in the previous trial. The Public Prosecutor assessed that the content of the exception, such as the police conducting a search in Lucinta's apartment without permission, is not true.

"Previously, the cumulative first and alternative second charges, as stated in the charges we have read before, are directly related to Article 127 paragraph 1 letter A of the Republic of Indonesia Law Number 35 of 2009, that in carrying out the search, the objection from the legal advisor is that the search conducted by the investigators of West Jakarta Police at the defendant's apartment is contrary to the mandate in Article 33 paragraph 1 of the Indonesian Criminal Code, and therefore legally flawed," said the Public Prosecutor.

1. Already Requested Permission from Apartment Management

The Public Prosecutor's Office emphasizes that when the West Jakarta Metro Police conducted a raid, they had already requested permission from the apartment management. Not only that, there were also several people who became witnesses in the incident.

"Our response is that in carrying out the search, it is not true that the investigators violated the provisions of Article 33 paragraph 1 of the Criminal Code, the action of the investigators did not first request permission from the chairman of the District Court in the jurisdiction, but the investigators implemented the provisions of Article 34 paragraph 1 of the Criminal Code," said the Public Prosecutor.

2. Rejecting the Exception Petition

Therefore, the Public Prosecutor's Office requests that the chairman of the panel of judges reject the exception petition from the defense counsel of the defendant, Ayluna Putri alias Lucinta Luna. The Public Prosecutor's Office also requests to continue the trial of the drug case.

"Based on the conclusions we have presented above, we request to the panel of judges of the West Jakarta District Court who examine and adjudicate this case to reject all the exception petitions from the defense counsel of the defendant Ayluna Putri alias Lucinta Luna," concluded the Public Prosecutor's Office.
