Before Entering the Court Related to Copyright, Ari Bias's Party Had Communicated with Agnez Mo but Did Not Receive a Response

After going through various stages, the Commercial Court finally issued a ruling that penalizes Agnez Mo for copyright infringement for performing a song owned by Ari Bias without permission. In the ruling, Agnez Mo is required to pay a fine of IDR 1.5 billion.

Ari Bias's attorney, Minola Sebayang, stated that this decision emphasizes the importance of respecting the rights of song creators. Before taking legal action, Ari Bias's party had tried various ways to resolve this issue amicably. However, according to Minola Sebayang, those efforts did not receive the expected response.

"So all this time we have gone through several stages, of course first a summons, before the summons Mas Ari had already tried to open communication with Agnez Mo's management and also the event organizers," said Minola Sebayang in the Fatmawati area recently.

"But there was no response, so an open summons was made to reach the concerned party because we did not know Agnez Mo's address, and it also did not receive a response," added Minola.

1. Upholding Justice for Song Creators

Minola also highlighted the view that singers do not need to ask for direct permission from song creators, but rather can do so through a Collective Management Institution (LMK). According to him, this makes many parties underestimate the importance of direct permission from the song creator.

"I don't understand and don't want to be suspicious, whether there is really no good faith and no respect for the composer or because they are still bound by the opinion that singers do not need to ask for permission from the song creators, just going to LMK is enough, so they feel it's not too concerning," he said.

In addition, Minola also responded to various speculations that arose regarding Ari Bias's motives for filing this lawsuit. He emphasized that the legal steps taken are to uphold justice for the song creators.

"I just found out that there is no rice, losing in online gambling, so I need money, but that is what ultimately led us to step into the Commercial Court. In the end, I declare that justice still exists after being doubted all this time. Today the creators finally believe, growing confidence that justice still exists," he said.

The court's decision serves as evidence that copyright infringement is not a trivial matter. If the fines that have been decided are not paid, then this reflects not only an attitude towards Ari Bias but also towards the legal decision that has been established.

"The ruling has stated that the defendant is guilty of violating the composer's Copyright by performing the song without permission. This is the law, no longer a matter of bargaining or negotiation like a warning. If the fine is not paid, then it is no longer Ari Bias who is being insulted but the court because the defendant has not complied with the decision," he explained.

2. Hoping for a Lesson Learned

Minola hopes Agnez Mo can use this case as a lesson and show an attitude that respects the law. By paying the fine as per the court's decision, Agnez Mo can actually demonstrate her commitment as a professional in the music industry.

"Perhaps all this time Agnez Mo has been in a dilemma, to pay or not, especially since many are convincing her that it doesn't need to be paid. With this certainty, there should no longer be a dilemma. She should be an example of a singer who obeys the rules; it will not make her lesser. Instead, she becomes a committed person," he explained.

Currently, Ari Bias's side is still waiting for the next steps from Agnez Mo. Minola emphasized that as a court ruling, the obligation to pay this fine must be adhered to without any further negotiation.

"We believe that she has not paid until now because she is still unsure, afraid that the payment might be wrong due to various opinions. She must comply, especially since it has already been finalized, and pay it to Mas Ari because it is a court decision, which will make her more respected and appreciated," he concluded.
