Demand Heavier Than Pablo Benua and Rey Utami, Galih Ginanjar's Lawyer Says BAP Fairuz Not in Accordance with the Facts

Kapanlagi.com - The trial of the foreign fish case involving Galih Ginanjar, Pablo Benua, and Rey Utami was held again. In this trial, the prosecutor read out the charges against the 3 defendants in the salted fish case.

In the continuation of the trial on March 23, 2020, based on the examination record (BAP) by Fairuz A Rafiq, the prosecutor demanded a heavier sentence for Galih Ginanjar compared to Rey and Pablo, namely Three Years and Six Months.

Sugiyarto Atmo Widjoyo, Galih Ginanjar's lawyer, said that based on the legal facts, in the video, it was not found that Galih Ginanjar ever mentioned what was in Fairuz A Rafiq's examination record.

"In point seven, it is mentioned that Galih said in the examination record 'Where at that time Galih Ginanjar Saputra and Rey Utami said that the intimate organs smell like salted fish, the intimate organs have fungus, because the intimate organs were injected or scraped until one spoonful of whitish fluid, the intimate organs have whitish fluid, the intimate organs smell because of changing partners' that's in point seven. Point seven and 18 are the same, and this becomes the main issue so Galih Ginanjar was reported to the police because of this main issue," said Sugiyarto Atmo Widjoyo when contacted by phone on Thursday (26.3).

1. BAP Fairuz Mengada-Ada

Furthermore, Sugiyarto explained that the BAP read by Fairuz was fabricated. In the video, Galih Ginanjar did not say what was mentioned in Fairuz's BAP. 

"Well, in reality, in legal fact, when the video was played, Galih did not say that. Galih did not say it, so personally I consider what Fairuz, as the complainant, stated in her BAP to be fabricated. Because in the legal fact of the video, it doesn't exist. Galih did not say it," he explained. 

2. Galih's Punishment Heavier Than Pablo and Rey Utami

According to Sugiyarto himself, the demand for Galih Ginanjar, which is heavier than Pablo Benua and Rey Utami, still raises questions. This is inseparable from Galih's role as a guest star, not the owner of the channel and uploader of the video. 

"That's what I also question. First, that Galih was just spontaneous there and the person invited there, he's a guest star, right? This is the ITE Law, where the language is 'Whoever distributes, transmits', like that. Galih is far from the person who uploads, distributes, transmits, far from there," he said.
